Fencing & Landscaping. Owner is required to adhere to the COM regulations regarding fencing and landscaping at or near the location of xxxxx drilled by Operator. Operator shall install a fence around each Drillsite Location, which fence shall be consistent with the fencing in the adjacent subdivision, but in any event, of a quality and style equivalent to that fencing which is around oil and gas operations in Pavilion Park, Section 8 or Daybreak Addition, unless the Operator shall otherwise agree with Owner and/or the adjacent surface developer, and shall be consistent with the requirements of the COM. Such fence shall replace the temporary fencing described in Article 4.2 hereof. All landscaping outside of such fence and on the Drillsite Location shall be at the sole cost and expense of Operator and shall comply with all landscaping requirements of the COM. As an alternative to the Operator complying with the landscaping requirements of the COM, and the foregoing permanent fencing requirements, the Owner and Operator agree to negotiate with the adjacent surface developer to attempt to agree to a price for which Operator will be responsible to pay to the adjacent surface developer which will allow the developer to install and maintain fencing and landscaping.

  • Landscaping Maintaining, tending and cultivating and (as necessary) re-stocking any garden or grassed areas including replacing plants, shrubs and trees as necessary.

  • Restrooms The restrooms, toilets, urinals, vanities and the other apparatus shall not be used for any purpose other than that for which they were constructed, and no foreign substance of any kind whatsoever shall be thrown therein. The expense of any breakage, stoppage or damage resulting from the violation of this rule shall be borne by the Tenant whom, or whose employees or invitees, shall have caused it.

  • Walls Sheetrock (drywall) damage should be patched and fire-taped so that there are no holes in either office or warehouse.

  • Elevators Landlord shall provide passenger elevator service during normal business hours to Tenant in common with Landlord and all other tenants. Landlord shall provide limited passenger service at other times, except in case of an emergency.

  • Elevator Landlord shall provide passenger elevator facilities on business days from 8:00 a.m. to 6:00 p.m. and shall have one elevator in the bank of elevators servicing the Premises available at all other times.

  • Plumbing fixtures and appliances shall be used only for the purposes for which designed, and no sweepings, rubbish, rags or other unsuitable material shall be thrown or deposited therein. Damage resulting to any such fixtures or appliances from misuse by a tenant or its agents, employees or invitees, shall be paid by such tenant.

  • Lighting Landlord will furnish both Building Standard and non-Building Standard lamps, bulbs, ballasts and starters that are part of the Leasehold Improvements for purchase by Tenant at Landlord's cost, plus Landlord's standard administration fee. Landlord will install non-Building Standard items at Landlord's scheduled rate for this service.

  • Roof Any Tenant-installed equipment must be removed with all roof penetrations properly repaired by a licensed roofing contractor approved by Landlord. Leaks arising from any Tenant-installed equipment or roof penetrations must be fixed in accordance with Landlord’s maintenance and repair recommendations.

  • HEATING Landlord shall furnish heat to the Premises when and as required by law, on business days from 8:00 A.M. to 6:00 P.M. Landlord shall not be responsible for the adequacy, design or capacity of the heating distribution system if the normal operation of the heat distribution system serving the Building shall fail to provide heat at reasonable temperatures or any reasonable volumes or velocities in any parts of the Premises by reason of any rearrangement of partitioning or other Alterations made or performed by or on behalf of Tenant or any person claiming through or under Tenant.

  • Sprinklers Subject to any terms, conditions and limitations set forth herein, Landlord shall provide an operative sprinkler system consisting of mains, laterals, and heads “AS IS” on the date of delivery of the Premises to Tenant. Tenant shall pay for piping distribution, drops and relocation of, or additional, sprinkler system heads and Building firehose or firehose valve cabinets, if Tenant’s Plans and/or any applicable Laws necessitate such.
