Filling Vacancies. (a) FRNP will fill internal vacancies within classifications via group seniority within that classification first before Recall and then Job Bid. (b) FRNP shall fill vacancies for positions in the following order: (1) Recall: A. Those qualified USW Local 550 represented employees in the same classification as the vacancy exist that were involuntarily laid off who accepted a position in a lower class in order of seniority. B. Those qualified USW Local 550 represented employees in the same job classification as the vacancy exist on the recall list that were involuntarily laid off from FFS, LSRS or FRNP, at Paducah in order of seniority C. Those qualified USW represented employees laid off at Portsmouth who apply for the vacancy, and who are covered under Section 3161 of the FY 93 Defense Authorization Act. F. Those qualified employees who were former employees of any other DOE contractor or subcontractor at other Department of Energy facilities and who are covered under Section 3161 of the FY 93 Defense Authorization Act (2) Job Bid: FRNP will post vacancies in classifications covered by this Agreement to provide job bid opportunity. A. Positions will be posted a minimum of ten (10) calendar days. B. The job bid opportunity is limited to employees of FRNP, at Paducah. C. Job bids will be awarded to the most senior qualified bidder from within a lower job classification. D. An employee selected to fill a new job or vacancy will be given reasonable time, not more than thirty (30) days, with proper instructions, to learn the specific tasks required on the job before final decision is made of his potential to perform the full scope of the job adequately. E. If it is evident before the end of the thirty (30) day period that he is not capable or does not possess the potential of handling or performing the full scope of the new job adequately, he shall be entitled to return to his former job with his former status. (c) Prior to filling vacancies, FRNP shall consult with the USW Local 550 concerning the availability of employees on the USEC, LATA, or LATA subcontractors (or environmental remediation contractor) at Paducah, S&S, or S&S subcontractors (or infrastructure contractor) at Paducah, BWCS (or DUF-6 contractor) at Paducah, recall list, and those eligible under Section 3161 of the FY 93 Defense Authorization Act. (d) In filling vacancies, FRNP shall provide a right of first refusal in order of bargaining unit seniority for available work within the classification for which the displaced employee can qualify. If no qualified employees can be obtained in a timely manner from (a)-(b) above, FRNP may hire qualified employees from any source. FRNP and USW Local 550 will work cooperatively to resolve questions and issues related to the application of this Section 4. (e) FRNP will maintain a recall list in the order of bargaining unit seniority of all laid off USW Local 550 represented employees covered in Paragraphs (b) (1)-(B&C) above. (f) USW Local 550 will maintain recall lists for those qualified USW Local 550 represented employees in Paragraph (b) (1) (D) above.

Those qualified USW Local 550 represented employees in classifications other than the one the vacancy exists in on the recall who were laid off from FRNP at Paducah in order of bargaining unit seniority. D. Those qualified USW Local 550 represented employees laid off or notified of a layoff at Paducah by USEC and other DOE contractors or subcontractors at Paducah in order of bargaining unit seniority E. Those qualified USW represented employees laid off at Portsmouth who apply first opportunity to bid their assignment for the vacancyensuing year. Employees shall not select runs that are scheduled on a daily basis, and who are covered under Section 3161 which exceed eight (8) hours per day without the permission of the FY 93 Defense Authorization Act. F. Those qualified employees Supervisor. The least senior driver(s) shall not bid on only a secondary run or an elementary run if it causes the District to hire another driver. Any Employee who were former employees is unable to attend the bid meeting shall be responsible for giving to the Association representative, his/her proxy bid which shall include his/her first three (3) choices. If none of any other DOE contractor his/her proxy choices are available, or subcontractor at other Department of Energy facilities and who are covered under Section 3161 of if no proxy has been received, then the FY 93 Defense Authorization Act (2) Job Bid: FRNP will post vacancies in classifications covered Employee shall be assigned a run/route as close as possible to their prior year's assignment by this Agreement to provide job bid opportunity. A. Positions will the Supervisor. Employees shall be posted a minimum of ten (10) calendar days. B. The job bid opportunity is limited to employees of FRNP, at Paducah. C. Job bids will be awarded to the most senior qualified bidder from within a lower job classification. D. An employee selected to fill a new job or vacancy will be given reasonable time, not more than thirty (30) daysminutes for their selection of their run/route. If the Employee does not make his/her selection within the allotted time allowed, with proper instructionsthen the Supervisor will assign their run/route for the year. Those present at the bid meeting shall be paid according to Transportation Wage Schedule A for their participation in the bid process. B. Filling vacancies during the school year. 1. Employees who are granted a short term leave of absence of up to ninety (90) work days shall have their runs/routes filled by the most senior driver available without a run/route in that time slot. If an unusual circumstance occurs, the timeline may be extended. The parties must mutually agree to learn extend the specific tasks required timeline. This will not require the run/route to be bid. If the timeline is not extended by mutual Agreement, the run/route will be bid after the 90th work day of the leave of absence. 2. If an Employee has a previously scheduled appointment, this shall not interrupt his/her right to continue on the job before final decision is made of his potential same run/route. Once awarded a temporary run/route, that driver will not be eligible to perform fill another until he/she has completed that temporary run/route. After completing the full scope of first temporary run/route, the job adequately. E. If it is evident before the end of the thirty (30) day period driver may bump a lower seniority driver from another temporary run/route if that he is not capable or does not possess the potential of handling or performing the full scope of the new job adequately, he shall be entitled to return to his former job with his former status. If a teacher refuses a position for a second (2nd) time during that period, he/she shall be considered to have resigned from the district and shall be removed from the recall eligible list. Filling Vacancies. (a) FRNP will A. A vacancy is defined as a bargaining unit position which the administration intends to fill internal vacancies within classifications via group seniority within that classification first before Recall and then Job Bid. (b) FRNP shall fill vacancies for positions in the following order: (1) Recall: A. Those qualified USW Local 550 represented employees in the same classification as the vacancy exist that were involuntarily laid off who accepted which is either newly created or which is vacant because of death, retirement, resignation, termination, non-renewal, or where a position in has become open following a lower class in order of senioritytransfer or transfers. B. Those qualified USW Local 550 represented employees All vacant bargaining unit positions shall be posted for a period of at least five (5) calendar days (excluding weekends and holidays) on the District website, and by electronic mail to the District email account of all bargaining unit members. 1. This provision shall in no way limit the authority of a building administrator to reassign staff within his/her building prior to the posting of a position, nor are such administrative reassignments subject to committee or site- based review. 2. All withdrawals of postings or amended postings will take place during the five (5) day posting period when possible. The Association will be consulted when there is an amendment or withdrawal after the five (5) day posting period and no posting will be created in an arbitrary or capricious way denying any bargaining unit member their rights. No amendment of a posting will take place after a twenty-five (25) day period following the expiration of the original posting. 3. Any vacancy arising after July 31st need not be posted and may be filled by a long-term substitute. Filling Vacancies. A. Temporary Vacancies 1. Temporary vacancies of less than a semester: a. If the District determines to fill a vacancy created by a teacher temporarily vacating his/her position for a period of twenty (a20) FRNP will fill internal vacancies within classifications via group seniority within that classification first before Recall and then Job Bidconsecutive days or less, it may do so with a day-to-day substitute. b. If the District determines to fill a vacancy created by a teacher temporarily vacating his/her position for a period of less than a semester but more than twenty (b20) FRNP consecutive days, it shall do so with a teacher under a conditional contract. 2. Temporary vacancies of more than a semester If the District determines to fill vacancies a vacancy created by a teacher temporarily vacating his/her position for positions in the following order: a period of more than one (1) Recall:semester, it shall, provided that such position remains vacant after recall procedures (Article X, Section J) have been exhausted, do so with a teacher under conditional contract. A. Those qualified USW Local 550 represented employees 3. Temporary vacancies of more than one (1) school year If the District determines to fill a vacancy created by a teacher temporarily vacating his/her position for a period of more than one (1) school year, it shall, provided that such position remains vacant after the recall procedures (Article X, Section J) have been exhausted, do so with a teacher employed under a regular teacher contract, except in the same classification as case of a disabled teacher wherein the temporary vacancy exist that were involuntarily laid off who accepted a position in a lower class in order of seniorityshall be maintained up to two (2) years. Permanent vacancies of less than one (1) semester If the same job classification as the vacancy exist on the recall list that were involuntarily laid off from FFS, LSRS or FRNP, at Paducah in order of seniority C. If it is evident before medically determined at a later date that a disabled teacher, whose position has been filled by a teacher employed under a regular teaching contract pursuant to the end terms of the thirty (30) day period that he is not capable or does not possess the potential of handling or performing the full scope of the new job adequatelythis provision, he shall be entitled has sufficiently recovered to return to his former job work, such disabled teacher shall be returned to the first open regular position for which he/she is certified and most senior. Filling Vacancies. (a) FRNP All vacancies of thirty (30) days or longer, all new jobs and all promotional jobs, covered by this Agreement, shall be bulletined within five (5) work days of notice of such vacancy occurring. The bulletin shall state whether the vacancy, or such vacancies or jobs are to be temporary or permanent, the number of jobs to be filled, the classification of each job, the location of each job, the qualification required, the place where bids are to be sent and the last date on which the bids will fill internal vacancies within classifications via group seniority within that classification first before Recall be received, which will be seven (7) calendar days after the date the bulletin is posted. An employee who is on vacation or on emergency field service, or on an assignment to a temporary job (for a period not exceeding fifteen (15) days) and then Job Bidis thereby unable to bid, may bid upon return to duty and displace the successful bidder if said bidder is junior to him. (e) A successful bidder shall hold the bulletined job for a period of thirty (30) days actually worked in the new job on a trial basis in order to demonstrate his ability to perform the work required by the job. Filling Vacancies. Policy For Filling Vacancies 14.1 The number of employees needed in any classification and the determination of the existence of a vacancy shall be at the discretion of the Company. Temporary Job Vacancies 14.2 A temporary job vacancy, i.e., a vacancy in a job which, in the opinion of the Company, will not exist for longer than thirty (30) days, may be filled by the Company without regard for the provisions of this Article. Should any such job continue in existence for a continuous period in excess of thirty (30) days, however, the selection of an employee to fill such job shall be carried out immediately following the temporary period in accordance with the procedure for filling regular job vacancies as hereinafter provided. Vacancies resulting from illnesses, leaves of absence, vacation, and/or intermittent work, may be filled by assignment as temporary jobs without regard for the time restriction of this paragraph. Where vacancies result from illnesses, leaves of absence, vacations, and/or intermittent work, they will be filled, as far as possible and convenient by the assignment thereto of those employees who would normally be promoted or assigned to fill such vacancies if the vacancies were regular job vacancies. Upon completion of the temporary assignment, those employees transferred or assigned to jobs as a result of this temporary assignment, shall revert to the jobs held by them immediately prior to the commencement of the assignment. Employees returning to their regular job after filling a temporary job vacancy will revert to the rate of pay for their regular job on date of transfer. Regular Job Vacancies 14.3 Regular job vacancies, i.e., job vacancies other than temporary job vacancies as defined in paragraph 14.2 hereof, shall be filled as follows: (a) FRNP will fill internal vacancies within classifications via group seniority within a regular job vacancy in any division shall be filled from the employees in that classification first before Recall and then Job Bid.division (except as outlined in paragraph 14.4(b) when a vacancy occurs, provided a qualified employee is available; (b) FRNP if a regular job vacancy in any division cannot be filled from the employees in that division when a vacancy occurs, qualified employees in other divisions shall be given the opportunity to transfer to the vacant job as hereinafter provided; (c) if a regular job vacancy cannot be filled by a qualified employee from within the plant, the Company may hire or transfer a person into the Bargaining Unit to fill the job. Procedure for Filling Regular Vacancies From Within the Same Division 14.4 When a regular vacancy occurs in a division, advice of such vacancy and all other vacancies that could result, shall be posted concurrently for positions seven (7) calendar days in the section(s) concerned and on the Main Posting Board. Employees shall be eligible for consideration for the original vacancy and resulting vacancies in the following order: (1a) Recall:Employees who hold recall rights to the vacant job classification. If two or more employees hold recall rights to the vacant job classification, the one with the greatest plant seniority shall be selected. A. Those qualified employees who were former employees of any other DOE contractor or subcontractor at other Department of Energy facilities and who are covered under Section 3161 of the FY 93 Defense Authorization Act (2) Job Bid: FRNP will post vacancies in classifications covered by this Agreement to provide job bid opportunity. A. Positions will be posted a minimum of ten (10) calendar days. B. The job bid opportunity is limited to employees of FRNP, at Paducah. C. Job bids will be awarded to the most senior qualified bidder from within a lower job classification. D. An employee selected to fill a new job or vacancy will be given reasonable time, not more than thirty (30) days, with proper instructions, to learn the specific tasks required on the job before final decision is made of his potential to perform the full scope of the job adequately. E. If it is evident before the end of the thirty (30) day period that he is not capable or does not possess the potential of handling or performing the full scope of the new job adequately, he greatest plant seniority shall be entitled to return to his former job with his former statusselected. (c) Prior Employees in related jobs of equal rate in the division, who have requested in writing, a transfer to filling vacanciesthe vacant job. (d) In filling vacanciesEmployees in the next lower group of related jobs in the division: Should there be significant differences between the employees' qualifications as defined in Paragraph 14.12, FRNP the best qualified employee shall provide a right of first refusal in order of bargaining unit be selected for the vacant job. Should there be no significant differences between employees' qualifications, the one with the greatest plant seniority for available work within the classification for which the displaced employee can qualifyshall be selected. If no qualified employee in this group desires the job, consideration shall then be given to those in the next lower group and so on. It is expected that, in most cases, employees will move up in the division so that the final vacancy will be in the lowest classification. Employees Requests for Transfer 14.5 It is recognized that the procedures in this Article generally provide for the filling of vacancies in any job above the lowest classification in a division by the promotion of employees then in that division. Therefore, under normal circumstances, the only vacancies in any existing division which can be obtained in a timely manner from (a)-(b) above, FRNP may hire qualified filled by transfer of employees from other divisions occur in the lowest classification. It is understood, therefore, that an employee who wishes to transfer to another division must normally enter that division in the lowest classification. From Other Divisions 14.6 When a vacancy in any sourcedivision cannot be filled by an employee from within that division, notice of such vacancy shall be posted for seven (7) calendar days on the Main Bulletin Board. FRNP Notwithstanding the foregoing limitations, all vacancies arising in the "CT-Craft Trainee" classification will be posted in the same manner. Each such notice shall indicate the date and USW Local 550 time at which the notice will work cooperatively expire, after which applications for the vacancy shall not be considered. 14.7 Employees desiring to resolve questions apply for the posted vacancy shall fill out an "Application for Transfer" form and issues related drop it in the box provided for that purpose in the Main Gate corridor. 14.8 Among those employees who have applied for the vacancy and who, in the opinion of the Company, have the qualifications to perform the job in question, the employee with the greatest plant seniority shall be selected. The name of the successful candidate will be added to the application job vacancy notice which will then be posted for an additional five (5) days. If no qualified employee applies for the vacancy, the Company may appoint an employee to fill the job. The Company may fill any vacancy by temporary action for such period as is necessary to complete the posting and filling of this Section 4such vacancy. 14.9 An employee who applies for and obtains a posted vacancy under this procedure shall not be eligible to apply for a posted vacancy in another division for a period of six (e6) FRNP will maintain a recall list months. (f) USW Local 550 will maintain recall lists for those qualified USW Local 550 represented employees 14.11 An employee who is selected to fill a vacancy in Paragraph (b) accordance with the provisions of this Agreement shall be allowed a trial period to become familiar with the new job. The trial period shall be from one (1) to a maximum of thirty (D30) abovedays depending on the nature of the job, but in any event the length of trial period in any particular instance shall be determined by the Company. If, at the conclusion of such trial period, he/she performs the work with the same reliability and with the same degree of efficiency as to quality and quantity as is regularly performed by employees on the same job or on similar jobs, he/she shall be considered competent to continue on such job. If, however, during or at the conclusion of such trial period, the employee's work and progress have not come up to standards acceptable to the Company, he/she shall be transferred back to his/her former job without loss of seniority.

Filling Vacancies. A. All vacancies shall be filled or the position shall be eliminated. A temporary vacancy shall be filled no more than twenty (a20) FRNP will fill internal calendar days after it becomes vacant unless an extension is granted by PSA. Such a request for extension shall not be unreasonably denied. A permanent vacancy shall be filled on a permanent basis within a reasonable period of time after it becomes vacant. However, this provision shall not preclude the possibility of filling a permanent vacancy with a temporary Employee for a reasonable period of time. Saturdays, Sundays and paid holidays shall not be counted as days. During a reduction in force (RIF), all permanent vacancies within classifications via group seniority within that classification shall be posted immediately but not filled until the thirty-first before Recall and then Job Bid(31st) day. These awarded vacancies shall not commence until the first day after the completion of the RIF. (b) FRNP B. Temporary and permanent vacancies shall fill vacancies for positions be filled through transfer in the following order: (1) Recall: A. Those qualified USW Local 550 represented . Filling Vacancies. (a) FRNP will fill internal vacancies within classifications via group seniority within that classification first before Recall and then Job Bid. (b) FRNP A. Annual Initial Bid Meeting: Prior to the beginning of each school year all run/routes shall fill vacancies be open for positions bidding. Prior to the conclusion of each school year each Employee shall be notified of the August bid meeting date. On the day prior to the scheduled bid meeting date, all runs/routes shall be available for viewing at the transportation office by the Employees. On the bid meeting day, each Employee shall select, in the following order: (1) Recall: A. Those qualified USW Local 550 represented employees in the same classification as the vacancy exist that were involuntarily laid off who accepted a position in a lower class in order of seniority, with the greatest seniority having the first opportunity to bid their assignment for the ensuing year. Employees shall not select runs that are scheduled on a daily basis, which exceed eight (8) hours per day without the permission of the Supervisor. The least senior driver(s) shall not bid on only a secondary run or an elementary run if it causes the District to hire another driver. Any Employee who is unable to attend the bid meeting shall be responsible for giving to the Association representative, his/her proxy bid which shall include his/her first three (3) choices. If none of his/her proxy choices are available, or if no proxy has been received, then the Employee shall be assigned a run/route as close as possible to their prior year's assignment by the Supervisor. Employees shall be limited to thirty (30) minutes for their selection of their run/route. If the Employee does not make his/her selection within the allotted time allowed, then the Supervisor will assign their run/route for the year. Those present at the bid meeting shall be paid Seven Dollars and 65/100 ($7.65) for their participation in the bid process. This pay for participation in the bid meeting shall be increased by the same percent as Wage Schedule A. B. Filling vacancies during the school year. B. Those qualified USW Local 550 represented employees 1. Employees who are granted a short term leave of absence of up to ninety (90) work days shall have their runs/routes filled by the most senior driver available without a run/route in that time slot. If an unusual circumstance occurs, the timeline may be extended. The parties must mutually agree to extend the timeline. This will not require the run/route to be bid. If the timeline is not extended by mutual Agreement, the run/route will be bid after the 90th work day of the leave of absence. 2. If an Employee has a previously scheduled appointment, this shall not interrupt his/her right to continue on the same job classification as run/route. Once awarded a temporary run/route, that driver will not be eligible to fill another until he/she has completed that temporary run/route. After completing the vacancy exist on first temporary run/route, the recall list driver may bump a lower seniority driver from another temporary run/route if that were involuntarily laid off from FFS, LSRS or FRNP, temporary assignment will have at Paducah in order of seniority C. Upon return from within a lower job classificationleave, the returning Employee shall assume his/her previously bid run/route unless there has been a seniority adjustment. All other Employees shall return to their prior run/route. g. An Employee who is on a leave of absence exceeding ninety (90) work days at the beginning of the school year, shall first bid his/her run/route, then Section B of this Article shall be implemented. h. Employees who are on an unpaid leave at the conclusion of a school year and wish to participate in the bid meeting at the start of the next school year must provide Human Resources with written notice that they are cleared to perform all duties, without restriction, as of severn (7) calendar days prior to the first student day of school from the Department of Transportation (DOT) doctor, or personal physician if DOT clearance is not required prior to Bid day. Extensions may be granted if mutually agreed upon between both parties. A description of the run/routes, approximate mileage, and approximate completion time will be provided at the bid meeting. 4. Whenever a driver accepts a temporary run/route due to a regular driver’s leave of absence of over ninety (90) days, the driver who accepts the temporary run/route must stay on that run/route for the duration of the temporary run/route. This individual may not bid on another temporary run/route until their current tempoprary run/route expires. If she/he goes on medical or emergency leave during the placement, she/he would resume that placement upon her/his return. 5. In the event a vacancy occurs during the school year, the vacancy will be filled by a one time internal posting awarded by seniority. The newly vacated position will be filled by a driver from outside the bargaining unit. The driver who accepts a vacancy during the school year will be ineligible to accept another vacancy for the remainder of the school year. ▇. ▇▇▇▇▇▇ Shared-Time Shuttle – if reinstated, will be split and bid on as separate runs. Filling Vacancies. (d) In filling vacanciesA protected Train Dispatcher who does not obtain a Train Dispatcher position which requires a change in residence shall be considered as having exhausted seniority as a Train Dispatcher. Filling Vacancies. (a) FRNP will fill internal vacancies Section 1. When an entry level position within classifications via group seniority within that classification first before Recall and then Job Bidthe department covered by this AGREEMENT becomes vacant the Sheriff shall notify the Missoula County Human Resources Department who shall promptly open up recruitment for the position, including placement of appropriate advertisements. (b) FRNP Section 2. All appointments, including new hires and promotions, shall fill vacancies be based on merit principles. Positions covered by this AGREEMENT open for promotion shall be filled by qualified persons within the bargaining unit when such persons are interested in and, are capable of performing the duties of the vacant position. Section 3. All new appointments to positions in the following order: bargaining unit shall be on a probationary basis for a period of one (1) Recall: A. Those qualified USW Local 550 represented employees in the same classification as the vacancy exist that were involuntarily laid off who accepted year. Employees serving a position in a lower class in order of seniority. B. Those qualified USW Local 550 represented employees in the same job classification as the vacancy exist on the recall list that were involuntarily laid off from FFS, LSRS or FRNP, probationary period will either attain regular status at Paducah in order of seniority C. Those qualified USW Local 550 represented employees in classifications other than the one the vacancy exists in on the recall who were laid off from FRNP at Paducah in order of bargaining unit seniority. A. Positions will be posted a minimum of ten (10) calendar days. B. The job bid opportunity is limited to employees of FRNP, at Paducah. C. Job bids will be awarded to the most senior qualified bidder from within a lower job classification. D. An employee selected to fill a new job or vacancy will be given reasonable time, not more than thirty (30) days, with proper instructions, to learn the specific tasks required on the job before final decision is made of his potential to perform the full scope of the job adequately. E. If it is evident before the end of the thirty probationary period or will be terminated by the Sheriff with or without cause and without recourse. Section 4. A promoted employee shall be required to serve a new trial period of six (306) day months, except that the Sheriff or his designee may extend such trial period that he is not capable or for up to an additional six (6) months. Promoted employees shall be evaluated at the end of each three (3) month period. In the event the promoted employee does not possess satisfactorily complete the potential trial period, the employee will be reverted to a position with a rank and rate of handling pay commensurate to that enjoyed by the employee before the promotion. Section 5. When a position allowing for promotion or performing transfer within the full scope department covered by this AGREEMENT becomes vacant the Sheriff shall notify the Missoula County Human Resources Department who shall promptly open up recruitment for the position, develop the posting, and post the notice of such vacancy on a bulletin board designated for such purposes at least seven (7) days, excluding Saturdays, Sundays and holidays, prior to filling such vacancy. When any additional duty assignment as listed in Article 29 or similar specialized duty assignment that does not include additional compensation is to be made, the Sheriff shall have Human Resources post a notice as described previously in this section. Section 6. The Human Resources department shall accept applications for all posted vacancies and promotions and ensure all candidates meet the minimum qualification requirements stated in the job description. After completion of initial screening and the department’s selection processes, a list of qualified applicants shall be referred to the Sheriff, or his designee, who shall make the final selection. Section 7. The Sheriff or selection committee shall establish selection criteria and a selection process prior to posting the position or additional duty assignment. Information on the selection process will be included in the posting. Examples of selection criteria and process activities include:  written,  oral interviews or assessment center examinations,  practical exercises,  seniority,  experience,  education,  training,  relative ability,  or other relevant, job-related factors. After reviewing applicants’ qualifications, the Sheriff or selection committee shall select finalists for interviews. Finalists shall be ranked based on the Sheriff’s or selection committee’s assessment of the new job adequately, he above factors and the finalists’ interviews. The final ranking shall be entitled available to return all the finalists and to his former job the Association President upon request. If the Sheriff’s Office changes the selection process for any bargaining unit position, or for additional duty assignments posted in accordance with his former status. (c) Prior section 5 of this Article the EMPLOYER agrees to filling vacancies, FRNP shall consult with notify the USW Local 550 concerning ASSOCIATION in writing sufficiently in advance of using the availability of employees selection procedure to allow the ASSOCIATION a reasonable opportunity to review and comment on the USEC, LATA, or LATA subcontractors (or environmental remediation contractor) at Paducah, S&S, or S&S subcontractors (or infrastructure contractor) at Paducah, BWCS (or DUF-6 contractor) at Paducah, recall list, and those eligible under Section 3161 of the FY 93 Defense Authorization Actchange. (d) In filling vacancies, FRNP shall provide a right of first refusal in order of bargaining unit seniority for available work within the classification for which the displaced employee can qualify. If no qualified employees can be obtained in a timely manner from (a)-(b) above, FRNP may hire qualified employees from any source. Filling Vacancies. (b) FRNP shall fill vacancies 1. The Administration will determine collapsed positions for positions the next academic year and will consult with PGC by March 15 or in the following event that a position is collapsed after March 15, PGC will be notified as soon as possible. Displaced bargaining unit members shall be determined as specified in Section A.1 above. A “ displaced bargaining unit member list” shall be forwarded to the Association by March 30. 2. Displaced bargaining unit members, in order from highest to lowest seniority, shall select from vacant positions for which they are certified and qualified, in the presence of the Superintendent and the President of the Association. 3. After placement of displaced teachers, vacancies may be filled by certified and qualified teachers whom the Administration, in consultation with PGC, justify that a transfer would facilitate the success of an IDP teacher or resolve a situation that negatively impacts the learning environment. 4. After placement of teachers through paragraphs 2 and 3 above, vacancies shall be filled by certified and qualified teachers within the building as an internal transfer. Vacancies shall be filled internally in this order: (1) Recall: A. Those qualified USW Local 550 represented employees in the same classification as the vacancy exist that were involuntarily laid off who accepted a position in a lower class in order of a. Successful teachers, from highest to lowest seniority. B. Those qualified USW Local 550 represented employees b. Voluntary IDP teachers, from highest to lowest seniority. The building administrator, subject to approval of the Personnel Department, will be responsible for authorizing the assignment and transfer of all existing teaching staff. The principal will confer with members of a building level advisor team to assist in determining appropriate changes. 5. If a posted vacancy has not been filled by an existing teacher within the same job classification as individual building, the vacancy exist on the recall list that were involuntarily laid off from FFS, LSRS or FRNP, at Paducah in order of seniority C. Those qualified USW Local 550 represented employees in classifications other than the one the vacancy exists in on the recall who were laid off from FRNP at Paducah in order of may be filled with any district-wide bargaining unit member that has a Request for Transfer form on file with the Personnel Department in accordance with Article 10(B). Vacancies shall be filled from outside a building in this order: a. Successful teachers, from highest to lowest seniority. D. Those b. Voluntary IDP teachers, from highest to lowest seniority. 6. Bargaining unit members may apply for vacant positions remaining unfilled as of the third Monday of March. Such posted vacancy, subject to the following paragraph, will be filled on the basis of the Matrix (Appendix 3) with Teacher experience in Owosso, certification/qualifications, Teacher experience-elsewhere (K-12 public/private), Teacher evaluation, interview, and Honors/recognition in education. The Matrix will include building expectations and a job description. Transfer rights will be available to teachers having an overall satisfactory rating on their most recent evaluation. Absent any evaluation within the last three years, a teacher will be assumed to have a satisfactory evaluation. Teachers may appeal to the Professional Governance Council (PGC in Article 18) regarding the denial of transfer rights. If an administrator is involved with the evaluation of the teacher appealing to the PGC and a member of the PGC, then he/she will be replaced for the resolution of the issue under consideration. If the teacher appealing the right to transfer is a member of the PGC, then he/she will be replaced for the resolution of the issue under consideration. Following an appeal to the PGC, a teacher may exercise the grievance process for resolution through the Board Level. 7. If a posted vacancy has not been filled by an existing bargaini ng unit member, as provided in Section D, Paragraphs 2 through 6 in this Article, said vacancy may be filled by an involuntary transfer of the lowest seniority certified and qualified USW Local 550 represented employees laid off or notified bargaining unit member, as provided in Section A, Paragraph 5.B, of this article. 8. Any vacancy created by the transfer of a layoff at Paducah by USEC and other DOE contractors or subcontractors at Paducah in order of bargaining unit senioritymember to another teaching assignment shall be offered to any and all individuals on the “ displaced bargaining unit member list” as positions open. The vacant position shall be filled through the process outlined above, starting at Section D Paragraph 2 of this Article. E. Those 9. If a position remains unfilled by an existing bargaining unit member, as provided in Section D, Paragraphs 2 through 8 in this Article being posted internally, the position shall be posted for an outside candidate. 10. Non-bargaining unit candidates will only be considered after all qualified USW represented employees laid off at Portsmouth who apply and certified bargaining unit members that applied for the vacancyvacancy have been considered. Annual Initial Bid Meeting: Prior to the beginning of each school year all run/routes shall fill vacancies be open for positions bidding. Prior to the conclusion of each school year each Employee shall be notified of the August bid meeting date. On the day prior to the scheduled bid meeting date, all runs/routes shall be available for viewing at the transportation office by the Employees. On the bid meeting day, each Employee shall select, in the following order: (1) Recall: A. Those qualified USW Local 550 represented employees in the same classification as the vacancy exist that were involuntarily laid off who accepted a position in a lower class in order of seniority, with the greatest seniority having the first opportunity to bid their assignment for the ensuing year. Employees shall not select runs that are scheduled on a daily basis, which exceed eight (8) hours per day without the permission of the Supervisor. The least senior driver(s) shall not bid on only a secondary run or an elementary run if it causes the District to hire another driver. Any Employee who is unable to attend the bid meeting shall be responsible for giving to the Association representative, his/her proxy bid which shall include his/her first three (3) choices. If none of his/her proxy choices are available, or if no proxy has been received, then the Employee shall be assigned a run/route as close as possible to their prior year's assignment by the Supervisor. Employees shall be limited to thirty (30) minutes for their selection of their run/route. If the Employee does not make his/her selection within the allotted time allowed, then the Supervisor will assign their run/route for the year. Those present at the bid meeting shall be paid according to Transportation Wage Schedule A for their participation in the bid process. B. Those qualified USW Local 550 represented employees in Filling vacancies during the school year. 1. Employees who are granted a short term leave of absence of up to ninety (90) calendar days shall have their runs/routes filled by a substitute driver. If an unusual circumstance occurs, the timeline may be extended. The parties must mutually agree to extend the timeline. This will not require the run/route to be bid. If the timeline is not extended by mutual Agreement, the run/route will be bid after the 90th calendar day of the leave of absence. 2. If an Employee has a previously scheduled appointment, this shall not interrupt his/her right to continue on the same job classification as run/route. Once awarded a temporary run/route, that driver will not be eligible to fill another until he/she has completed that temporary run/route. After completing the vacancy exist on first temporary run/route, the recall list driver may bump a lower seniority driver from another temporary run/route if that were involuntarily laid off from FFS, LSRS or FRNP, temporary assignment will have at Paducah in order of seniority C. Runs/routes will be awarded to the most senior qualified bidder regular driver that bids on the run/route. e. All changes in runs/routes will be implemented as soon as possible, but no later than three (3) work days after the bid meeting. f. The driver who accepts a vacancy during the school year will be ineligible to accept another vacancy for the remainder of the year. g. Drivers awarded a temporary run/route will not be eligible to fill another until they have completed that run/route. Upon return from within a lower job classificationleave, the returning Employee shall assume his/her previously bid run/route unless there has been a seniority adjustment. All other Employees shall return to their prior run/route. h. An Employee who is on a leave of absence exceeding ninety (90) work days at the beginning of the school year, shall first bid his/her run/route, then Section B of this Article shall be implemented. i. Employees who are on leave at the conclusion of a school year and wish to participate in the bid meeting at the start of the next school year must provide Human Resources with written notice that they are cleared to perform all duties, without restrictions, seven (7) week days prior to Bid Day. Clearance is required from the Department of Transportation (DOT) doctor, or personal physician if DOT clearance is not required. Extensions may be granted if mutually agreed upon between both parties. A description of the run/routes, approximate mileage, and approximate completion time will be provided at the bid meeting. 4. Whenever a driver accepts a temporary run/route due to a regular driver’s leave of absence of over ninety (90) days, the driver who accepts the temporary run/route must stay on that run/route for the duration of the temporary run/route. This individual may not bid on another temporary run/route until their current temporary run/route expires. If she/he goes on medical or emergency leave during the placement, she/he would resume that placement upon her/his return. ▇. ▇▇▇▇▇▇ Shared-Time Shuttle – if reinstated, will be split and bid on as separate runs. D. Filling Vacancies. (a) FRNP will A. A vacancy is defined as a bargaining unit position which the administration intends to fill internal vacancies within classifications via group seniority within that classification first before Recall and then Job Bid. Those qualified USW Local 550 represented employees All vacant bargaining unit positions shall be posted for a period of at least five (5) calendar days (excluding weekends and holidays) on the District website, 1. This provision shall in no way limit the authority of a building administrator to reassign staff within his/her building prior to the posting of a position, nor are such administrative reassignments subject to committee or site-based review. In such cases, the Superintendent will inform the Association President. 2. All withdrawals of postings or amended postings will take place during the five (5) day posting period when possible. The Association will be consulted when there is an amendment or withdrawal after the five (5) day posting period and no posting will be created in an arbitrary or capricious way denying any bargaining unit member their rights. No amendment of a posting will take place after a twenty-five (25) day period following the expiration of the original posting. 3. Any vacancy arising after July 31st need not be posted and may be filled by a long-term substitute. If filled by a long-term substitute, the position will be posted in advance of the following school year. 4. The candidacy of both internal and external candidates may be evaluated simultaneously. 5. (d) In filling vacancies, FRNP shall provide a right of first refusal in order of bargaining unit seniority for available work within the classification only position for which the displaced employee can qualify. If no qualified employees can be obtained in a timely manner from (a)-(b) above, FRNP may hire qualified employees from any source. FRNP and USW Local 550 will work cooperatively to resolve questions and issues related to the application of this Section 4. (e) FRNP will maintain a recall list in the order of intended RIF bargaining unit seniority of all laid off USW Local 550 represented employees covered in Paragraphs (b) (1)-(B&C) abovemember is certified/licensed. Filling Vacancies. (a) FRNP will fill internal vacancies within classifications via group seniority within that classification first before Recall and then Job Bid. (b) FRNP A. Annual Initial Bid Meeting: Prior to the beginning of each school year all run/routes shall fill vacancies be open for positions bidding. Prior to the conclusion of each school year each Employee shall be notified of the August bid meeting date. On the day prior to the scheduled bid meeting date, all runs/routes shall be available for viewing at the transportation office by the Employees. On the bid meeting day, each Employee shall select, in the following order: (1) Recall: A. Those qualified USW Local 550 represented employees in the same classification as the vacancy exist that were involuntarily laid off who accepted a position in a lower class in order of seniority. B. Those qualified USW Local 550 represented employees in , with the same job classification as greatest seniority having the vacancy exist on the recall list that were involuntarily laid off from FFS, LSRS or FRNP, at Paducah in order of seniority C. Those qualified USW Local 550 represented employees in classifications other than the one the vacancy exists in on the recall who were laid off from FRNP at Paducah in order of bargaining unit seniority. D. Those qualified USW Local 550 represented employees laid off or notified of a layoff at Paducah by USEC and other DOE contractors or subcontractors at Paducah in order of bargaining unit seniority E. Those qualified USW represented employees laid off at Portsmouth who apply first opportunity to bid their assignment for the vacancyensuing year. Employees shall not select runs that are scheduled on a daily basis, and who are covered under Section 3161 which exceed eight (8) hours per day without the permission of the FY 93 Defense Authorization Act. F. Those qualified employees Supervisor. The least senior driver(s) shall not bid on only a secondary run or an elementary run if it causes the District to hire another driver. Employees who are granted a short term leave of absence of up to ninety (90) work days shall have their runs/routes filled by a substitute driver. If an unusual circumstance occurs, the timeline may be extended. The parties must mutually agree to learn extend the specific tasks required timeline. This will not require the run/route to be bid. If the timeline is not extended by mutual Agreement, the run/route will be bid after the 90th work day of the leave of absence. 2. If an Employee has a previously scheduled appointment, this shall not interrupt his/her right to continue on the job before final decision is made of his potential same run/route. Once awarded a temporary run/route, that driver will not be eligible to perform fill another until he/she has completed that temporary run/route. After completing the full scope of first temporary run/route, the job adequately. E. If it is evident before the end of the thirty (30) day period driver may bump a lower seniority driver from another temporary run/route if that he is not capable or does not possess the potential of handling or performing the full scope of the new job adequately, he shall be entitled to return to his former job with his former status. (c) Prior to filling vacancies, FRNP shall consult with the USW Local 550 concerning the availability of employees on the USEC, LATA, or LATA subcontractors (or environmental remediation contractor) temporary assignment will have at Paducah, S&S, or S&S subcontractors (or infrastructure contractor) at Paducah, BWCS (or DUF-6 contractor) at Paducah, recall list, and those eligible under Section 3161 of the FY 93 Defense Authorization Act.
