Final Decision by the Board of Trustees. A. The Board review shall be based on the record of the hearing. B. The final decision to dismiss or not to dismiss shall rest with respect to both the facts and the decision, with the Board of Trustees after giving reasonable consideration to the recommendations of the Dismissal Review Committee and the Hearing Officer. C. The Dismissal Review Committee‘s recommendations and the findings, conclusions, and recommended decision of the Hearing Officer shall be advisory only and in no respect binding in fact or law upon the decision maker, the Board of Trustees. D. The Board of Trustees shall, within a reasonable time following the conclusion of its review, notify the affected faculty member in writing of its final decision and the effective date of dismissal.
