For Supply of Coal by road i/ The quantity of Coal not supplied by the Seller owing to omission or failure on the part of Purchaser to book value paid orders for the Scheduled Quantity in terms of Clause 7.2.2. ii/ The quantity of Coal not supplied by the Seller owing to Purchaser’s failure to place the requisite number / type of road transport at the Delivery Point for delivery of Coal within the validity period of the sale order/delivery order.
For Supply of Coal by road. (a) The quantity of the Contracted Grade of Coal not supplied by the Seller owing to omission or failure on the part of the Purchaser to book orders for the Scheduled Quantity in terms of Clause 8.2.2.
(b) The quantity of the Contracted Grade of Coal not supplied by the Seller owing to the Purchaser’s failure to place the requisite number / type of road transport at the Delivery Point for delivery of the Contracted Grade of Coal within the validity period of the sale order/delivery order.
(c) The quantity of the Contracted Grade of Coal not supplied by the Seller owing to the Seller exercising the right of suspension of supplies in terms of Clause 14.
(d) The quantity of the Contracted Grade of Coal not supplied by the Seller owing to the Purchaser failing or omitting to fulfill the requirements under Clause 12.
(e) The quantity of the Contracted Grade of Coal offered by the Seller which is not accepted by the Purchaser.
For Supply of Coal by road. (a) The quantity of the Contracted Grade of Coal not supplied by the Seller owing to the Purchaser’s failure to place the requisite number / type of road transport at the Delivery Point for delivery of the Contracted Grade of Coal within the validity period of the sale order.
(b) The quantity of the Contracted Grade of Coal not supplied by the Seller owing to the Seller exercising the right of suspension of supplies in terms of Clause 14.
(c) The quantity of the Contracted Grade of Coal offered by the Seller which is not accepted by the Purchaser.
For Supply of Coal by road ropeways/MGR/belt conveyor
(a) The quantity of Coal not supplied by the Seller owing to the Purchaser’s failure to pay and/or submit IRLC, as applicable, in accordance with Clause 12.1.2(ii).
(b) The quantity of Coal not supplied by the Seller owing to the Seller exercising the right of suspension of supplies in terms of Clause 15.
(c) The quantity of Coal not supplied by the Seller owing to the Purchaser’s failure to place the requisite number/type of transport at the Delivery Point for delivery of Coal within the validity period of the sale order/delivery order.
(d) The quantity of Coal offered by Seller in terms of Clause 4.3 not accepted by the Purchaser.
For Supply of Coal by road. The quantity of the Contracted Grade of Coal not supplied by the Seller owing to the Purchaser’s failure to place the requisite number / type of road transport at the Delivery Point for delivery of the Contracted Grade of Coal within the validity period of the sale order.
For Supply of Coal by road i. The quantity of Coal not supplied by the Corporation owing to omission or failure on the part of purchaser to provide the Security Deposit or any part thereof in accordance with this clause 3.1.2 or 3.1.3, as the case may be.
ii. The quantity of Coal not supplied by the Corporation owing to omission or failure on the part of Purchaser to book value paid orders for the Monthly Scheduled Quantities as per Clause 4.13 and within the period mandated under Clause 8.
iii. Deleted.
iv. Deemed Delivered Quantity in terms of Clauses 6.2 shall be calculated monthly basis during a year.
