Build – Up Period. Build-Up Period shall be the period of 6 months commencing on the First Delivery Date. In case CIL decides at its sole discretion to import Build-up period shall be extended for a further period of six months for commencing supply of imported coal. During the Build-Up Period any compensation arising on account of short supply or short lifting, as per Clause 3.6 of this Agreement, during the Build up period shall not be payable by either Party. Supply of coal by Seller shall start only after the Purchaser’s power plant becoming ready to start lighting up the boilers, to be confirmed by the Purchaser to the Seller in writing with documentary evidence.
Build – Up Period. 2.10.1 The Build-Up Period shall be the period of 6 months commencing on the First Delivery Date. During the Build-Up Period any compensation arising on account of short supply or short lifting, as per Clause 4.5 of this Agreement shall not be payable by either Party.
2.10.2 The indicative coal quantities to be supplied by the Seller and to be purchased by the Purchaser during the Build- Up Period is shown below. For avoidance of doubt, it is clarified that the quantities mentioned are indicative and the actual scheduled quantities may exceed or be lower compared to the quantities indicated above. The quantities shall however not exceed the pro-rated contracted quantities under this Agreement Build-Up Period [A period of 6 month from First Delivery Date]

Build – Up Period. Build-Up Period shall be the period commencing from the First Delivery Date till the Commercial Operation Date of the Washery (“Build-Up Period”). Any compensation arising on account of short supply or short lifting, as per Clause 6.6 of this Agreement during the Build- up Period shall not be payable by either Party.
Build – Up Period. 2.7.1 Build-Up Period shall be the period of six (6) Months commencing on the First Delivery Date (“Build-Up Period”). During the Build-Up Period, any compensation arising on account of short supply or short lifting, as per Clause 4.7 of this Agreement, shall not be payable by either Party.
Build – Up Period. Build-Up Period shall be the period commencing from the First Delivery Date till such time the Mine is actually commissioned. During the Build-Up Period any compensation arising on account of short supply or short lifting in this Agreement, during the Build up period shall not be payable by either Party

Whereas other provisions of this Agreement shall remain valid and enforceable for coal supplies during the Build up period, any compensation arising on account of short supply or short lifting, as per Clause 4.6 of this Agreement, during the Build up period shall not be payable by either Party.

Build – Up Period. 4.8.1. On and from the Commercial Start Date until the date one (1) Day before the Full ACQ Date (the “Build-Up Period”), Seller shall use reasonable efforts to sell and make available to Buyer at the Delivery Points, and Buyer shall use reasonable efforts to purchase and take a daily quantity of LNG that gradually increases to a daily quantity of LNG that allows Buyer to receive forty-one million five hundred thousand (41,500,000) MMBtus on an annual basis at least thirty (30) Days prior to the last Day of the Build-Up Period (the total quantity delivered during the Build-Up Period, the “Build-Up Quantity”). The Parties acknowledge and agree that (a) Seller’s delivery of and Buyer’s receipt of LNG during the Build-Up Period will be on a non-firm basis and (b) Buyer shall use reasonable efforts to receive a daily amount of LNG that enables Buyer to receive *** on an annual basis no later than thirty (30) Days after the Commercial Start Date.
4.8.2. No later than sixty (60) Days before the start of the Build-Up Period, the Joint Sub-Committee, established pursuant to Section 4.9, shall finalize an initial schedule for Seller’s delivery of and Buyer’s receipt of the Build-Up Quantity (the “Build-Up Period Schedule”). The Joint Sub-Committee may modify the Build-Up Period Schedule, as deemed necessary, by mutual agreement of Buyer and Seller, such agreement not to be unreasonably withheld or delayed.
4.8.3. The Monthly Fee for LNG delivered by Seller and received by Buyer during the Build-Up Period shall be determined in accordance with Exhibit A (Pricing). Buyer acknowledges that the CTS Services Agreement may not be effective prior to the Full ACQ Date, and in that event Seller shall use, or cause FLNG to use, commercially reasonable efforts to procure transportation capacity on the Coastal Transmission System on an interruptible basis as necessary to deliver sufficient quantities of Gas to produce the Build-Up Quantity. Unless otherwise agreed by the Parties, Seller shall cause FLNG to procure Gas at Huntingdon at spot market prices as necessary to produce the Build-Up Quantity.
Build – Up Period. A. Build-Up Period shall commence immediately after the First Delivery Date. The Build-Up Period shall be a period of 1 Year from the First Delivery Date.
B. The Purchaser shall 12 months before the last date of Target Start Period indicate the firm monthly coal quantities for a period of 12 months as per Annexure 4. The total of such scheduled quantities in the 12 month period shall be the Contract Quantity for the first contract year. The total of monthly quantities under the Build- Up Period shall however not exceed the Contracted Quantity as defined under Clause 4.1
Build – Up Period. Any containers interchanged prior to November 1, 1997 shall be leased from the date of its interchange through October 31, 2005 at the per diem rate set out in Paragraph C.
