For Texas Customers. To the fullest extent permitted under Texas law, an action or proceeding to enforce an obligation, duty or right arising under this Agreement or by law with respect to your account or any account service must be commenced no later than two years after the day the cause of action accrues. We comply with federal and applicable state record retention laws and may dispose of any records that have been retained or preserved for the period set forth in these laws. Any action against us must be brought within the period that the law requires us to preserve records, unless applicable law or this Agreement provides a shorter limitation period. Any action against us on an automatically renewable CD must be brought within the time that the law requires us to preserve records based on the stated maturity date in the most recent record of the CD.
