Business Customers. These Terms and Conditions apply to business customers only.
Business Customers. The Services are solely intended and designed to be used by professional business customers in the construction and sub-construction industries, energy system contraction and in building maintenance, and not intended to be used by any other fields of business or private end consumers (“Field of Use”). Notwithstanding section 8.2, Customer waives any and all warranty and liability claims and remedies resulting due to Customer`s usage of the Services outside the Field of Use.
Business Customers. These Terms and Conditions also apply to customers procuring Services in the course of business.

Business Customers. 14.1 The conditions of this contract and its ordinances will apply to all employees that belong to the subscription who have signed the contract.
14.2 In the event that the subscriber asks to include any of their employees as additional drivers for the use of the services provided under this agreement, the Subscriber agrees to provide all of the employee’s information and have the employee sign the contract and provide the employee with a copy of the contract and its appendices as well as the User Guide and authorize, with that employee’s signature, that he has fulfilled these requirements.
14.3 Without derogating from the provision set forth above, every employee of the subscriber who uses the serve in practice will be considered to have signed the agreement themselves and the Subscriber will be liable for the fulfillment of all of the employee requirements for all intents and purposes.
Business Customers. If the electricity supplied to the premises is used wholly or mainly for business purposes, our liability to you in relation to that premises, and your liability to us in relation to that premises, will (subject to the limitations in clause 9) be limited to a maximum of £100,000 per calendar year.
Business Customers. Where the Customer is in trade, and is purchasing Capital Goods, Goods and/or Services from TRT for a business purpose, to the extent permitted by applicable law:
(a) the parties agree that the Australian Consumer Law shall not apply to the sale of Capital Goods, Goods and/or Services;
(b) except as expressly set out in Terms or otherwise agreed in writing with TRT, the Capital Goods, Goods and/or Services are provided by TRT on an “as is” basis, without any guarantee, warranty, condition or representations (whether express, implied by law, statute, trade custom or otherwise) including without limitation in relation to quality of any purchasing Capital Goods, Goods and/or Services, merchantability, suitability for purpose, ownership, or otherwise, whether pursuant to the Australian Consumer Law, applicable law or regulations, or otherwise;
(c) the Customer agrees and acknowledges that the Customer enters into these Terms solely in reliance upon its own judgment as to the quality, durability and fitness of the Capital Goods and/or Goods for the Customer’s purposes;
(d) with respect to the sale of Capital Goods and/or Goods that are new, and are manufactured by a third party and resold by TRT to the Customer:
(i) TRT will use its reasonable endeavours to pass on the benefit of any associated manufacturer warranty to the Customer. For the avoidance of doubt, TRT does not to the extent permitted by law, give any warranties in addition to those provided by the original manufacturer (if any); and
(ii) TRT will provide reasonable assistance where the Customer wishes to make a claim against a manufacturer’s warranty.
(e) where the Customer is in trade, and purchasing Capital Goods, Goods and/or Services from TRT for a business purpose, to the extent permitted by applicable law, the Customer agrees that their exclusive remedy pursuant to any claim for breach of warranty set out in this clause 8 is limited to the repair, replacement or reperformance of the applicable Capital Goods, Goods and/or Services, or the provision of a credit or refund (whether in full or in part), as determined by TRT in its sole discretion.

Business Customers. If you are a Business Customer, you agree and acknowledge that for the purposes of compliance with Data Protection Legislation, both Parties act as independent Data Controllers in relation to any Personal Data Processed pursuant to these Terms. As such, you agree to comply with all Data Protection Legislation in relation to any Personal Data that you share with us. In particular, you confirm to us that:
a) all Personal Data which you or any of your officers, employees, agents or sub-contractors supply to us at any time has been lawfully obtained and will be lawfully supplied to us in accordance with Data Protection Legislation, and
b) all notices have been provided and relevant consents have been obtained (or an alternative legal ground for processing Personal Data has been relied on) as may be required under the Data Protection Legislation for us to process the Personal Data as contemplated by these Terms.
