FORGIVENESS OF UNCOLLECTED FEES. Uncollected Fees shall be forgiven in full within 10 days after the Effective Date. Defendant shall update any negative reporting to Chexsystems or credit reporting agencies with respect to Settlement Class Members who receive forgiveness of Uncollected Fees.
FORGIVENESS OF UNCOLLECTED FEES. Defendant shall forgive all Uncollected Fees as defined in Section 1(v) and as identified by the Settlement Administrator. The forgiveness provided for in this Section 3 shall not apply to any unpaid balances owing by Class Members other than Uncollected Fees.
FORGIVENESS OF UNCOLLECTED FEES. Upon the occurrence of the Effective Date, Defendant shall forgive the Uncollected Fees as defined in Section 1(ee) which are the Uncollected Fees portion of any amounts owing to Defendant by Settlement Class Members to the extent, if any, Defendant is attempting to collect thereon. If any Uncollected Fees are inadvertently collected, then they shall be refunded by Defendant insofar as Defendant is aware of the Uncollected Fees. If a Settlement Class Member with Uncollected Fees attempts to open a new account or re-open a closed account, Defendant shall not require payment of the Uncollected Fees as a condition to account opening insofar as Defendant is aware of the outstanding Uncollected Fees; however, nothing contained herein shall obligate Defendant to accept an application from a Settlement Class Member to open a new account or re-open a closed account.
FORGIVENESS OF UNCOLLECTED FEES. Defendant shall forgive, waive and write off all Uncollected Fees within 120 days of the Effective Date.
FORGIVENESS OF UNCOLLECTED FEES. Defendant shall forgive all Uncollected Fees as defined in Section 1(y) and as identified by the Settlement Administrator. Defendant shall use best efforts to update its internal records to remove Uncollected Fees from any negative balances, and to update any negative reporting to Chexsystems or credit reporting agencies with respect to Class Members who receive forgiveness of Uncollected Fees to the extent of the Uncollected Fees. The forgiveness provided for in this Section 2 shall not apply to any unpaid balances owing by Class Members other than Uncollected Fees.
FORGIVENESS OF UNCOLLECTED FEES. Subject to the conditions provided for in this Agreement, Defendant shall forgive all Uncollected Fees.
FORGIVENESS OF UNCOLLECTED FEES. Defendant shall forgive all Uncollected Retry Fees. The forgiveness provided for in this Section 2 shall not apply to any unpaid balances owing by Settlement Class Members other than Uncollected Retry Fees.
