Functies. Het asbestfonds geeft een tegemoetkoming aan slachtoffers. Het is de bedoeling dat de werknemer, zo mogelijk, volledig verhaal neemt op de werkgever. Ik behandel in deze paragraaf daarom zowel de vervulling van de functies indien slechts een tegemoetkoming wordt verkregen, als de vervulling van de functies wanneer ook een schadevergoeding na bemiddeling of een civiele procedure volgt.66 Ik begin met de tegemoetkoming. Slachtoffers met een vordering die niet meer verhaalbaar is op de werkgever, vanwege verjaring, faillissement of onvindbaarheid van de werkgever, krijgen uitsluitend een tegemoetkoming. Zij krijgen een gedeelte van hun schade vergoed. Aan de compensatiefunctie wordt dus gedeeltelijk voldaan. Met de uitkering krijgt het slachtoffer ook gedeeltelijke erkenning van zijn slachtofferschap. Als er geen verhaal mogelijk is, krijgt het slachtoffer geen genoegdoening zoals in het aansprakelijkheidsrecht gegeven wordt. Hij kan dan tevens gehoord worden. Bij de aanvraag wordt hij zo nodig geholpen door een medewerker die op huisbezoek komt. Slachtoffers zijn tevreden over die mogelijkheid en geven het huisbezoek het cijfer 8,5 op een schaal van 1 tot 10.67 Het enige punt dat ontbreekt, is dat het slachtoffer niet meer zijn verhaal kan doen ten overstaan van de dader, zoals dat in een civiele procedure kan. Wel wordt het slachtoffer waardig en respectvol bejegend door het Instituut asbestslachtoffers en tijdens de eventuele bezwaar- en beroepsprocedures. De medewerker die het slachtoffer begeleidt bij de aanvraag zal ook alle benodigde informatie over de procedure verschaf- fen. Ten slotte kan de procedure van twee maanden als snel worden beoor- deeld. Als het gaat om de tegemoetkoming, geeft het asbestfonds door de slechte scores op de functies genoegdoening en preventie, slechts in beperkte mate plaats voor de overkoepelende functie rechtshandhaving.
