FUNCTIONS OF MANAGEMENT. 4.01 The Union agrees that the Employer has the exclusive right and power to manage its business to direct the working forces and to suspend, discharge or discipline employees for just and sufficient cause, to hire, promote, demote, transfer or lay-off employees, to establish and maintain reasonable rules and regulations covering the operation of the stores, provided however, that any exercise of these rights and powers in conflict with any of the provisions of this Agreement shall be subject to the provisions of the Grievance Procedure as set out herein.
FUNCTIONS OF MANAGEMENT. 4.01 The provisions contained in Article 4 of this Agreement affect all employees covered by this Appendix.
FUNCTIONS OF MANAGEMENT. 01. The Company shall have the right at any time to hire skilled employees from outside whenever, in management’s opinion, properly skilled help is not available within the mill.
FUNCTIONS OF MANAGEMENT. Section 1. Unless limited by an express provision of this Agreement, the rights retained exclusively by, and solely to, management shall include, but are not limited to, the following: (1) to direct and supervise the work of its workers and Employees; (2) to subcontract work as long as no unit member is laid off because of the subcontracting; (3) to plan, direct and control operations, schedules and materials; (4) to determine and from time to time re-determine the amount and quality of the work needed, by whom it shall be performed and the location where such work shall be performed; (5) to determine and from time to time re-determine to what extent any process, service or activities of any nature whatsoever shall be added, modified, eliminated or obtained by contract with any other person or employer; (6) to partially or completely relocate or terminate operations; (7) to introduce different methods, automation, tools, equipment or facilities, or to change existing service practices, methods, tools, equipment and facilities; (8) to determine and regularly re-determine the number of hours per day or week operations shall be engaged in; (9) to select and to determine and from time to time re-determine the number of, qualifications of and types of employees required and to be hired; (10) to assign work and to determine the amount and quality of work to be performed by Employees in accordance with the requirements determined by the Company; (11) to determine the sequence and type of operating processes within the facility and (12) to take such measures as management may determine, and regularly re-determine, to be in the best interests of the orderly and efficient operation of the Company.
FUNCTIONS OF MANAGEMENT. The Union agrees that the Employer has the exclusive right and power to manage its business, to direct the working forces and to suspend, discharge, or discipline employees for just and sufficient cause, to hire, promote, demote, transfer or lay off employees, to establish and maintain reasonable rules and regulations covering the operation of the stores, provided however, that any exercise of these rights and powers in conflict with any of the provisions of this Agreement shall be subject to the provisions of the grievance procedure as set out herein. Should an adjustment in the part-time work force become necessary during the lifetime of this Collective Agreement as a direct result of the installation of Scanner Cash Register equipment, the Employer and the Union will meet to discuss an equitable solution to the problem at least thirty days prior to the implementation of the adjustment. Such discussion will not impede the Employer’s right to initiate the necessary adjustment. The question of the correctness of the Employer’s decision may be subject to the decision of a Board of Arbitration or a single Arbitrator under the provisions of Article of this Collective Agreement. It is agreed that the direction of the working force shall be at the discretion of the Employer within the terms of this Agreement. The Union agrees that the Employer has the exclusive right and power to study or introduce new or improved production and/or handling methods or facilities and the Union agrees to co-operate with the Employer in the installation of any such methods and in the education of its members for the necessity of such changes and improvements. The above rights shall be exercised subject to the provisions of the Grievance Procedure as set forth in this Agreement. The parties agree that the foregoing enumeration of Management’s rights shall not be deemed to exclude other functions of Management not specifically covered in this Appendix. The Employer, therefore, retains all rights not otherwise specifically covered in this Appendix.

FUNCTIONS OF MANAGEMENT. 4.1 The Union recognizes the right of the Company to hire, promote, demote, transfer, retire, suspend, or otherwise discipline an employee for just cause; and to increase or decrease working forces, subject to the right of members concerned to lodge a grievance in the manner provided for in the Agreement if they believe they have been demoted, transferred or passed over for promotion in violation of this Agreement, or have been suspended, disciplined, or discharged without just cause.
FUNCTIONS OF MANAGEMENT. 5.01 It is agreed that the Company has the sole and exclusive right to manage the affairs of the business and to direct the working forces of the Company. Such functions of management include (but are not limited to) the exclusive right to:

In the exercise of its function of management, the Employer shall have the right to plan, direct and control operations of all its work, hire employees, direct the working forces in the field, assign employees to their jobs, discharge, suspend or discipline for proper cause (proper cause for discharge includes but is not necessarily limited to incompetence, insubordination, habitual tardiness or absenteeism) transfer, promote or demote employees, lay off employees because of the lack of work, or for other legitimate reasons, require employees to observe the Employer’s rules and regulations not inconsistent with this Agreement, institute a fair and consistently applied drug policy, regulate the amount of equipment used and the use of equipment and other property of the Employer, decide the number of employees needed; provided, however, that the Employer will not use its rights for the purpose of discrimination against any employee. On work as defined under Article II, the Employer and the Union recognize the necessity of promoting efficiency and agree that no local rules, customs or practices shall be permitted that limit production or manpower required to do the work and that no limitations shall be placed on the amount of work which an employee is performing during the work day. No regulations of tools shall be interpreted or enforced in any way to prevent their use where required or necessary to perform an acceptable job in accordance with specifications of the appropriate agency and where all proper safety regulations are enforced.
