Common use of General Common Elements Clause in Contracts

General Common Elements. The warranty given in this Section 8 with respect to the newly constructed general Common Elements shall be in favor of Purchaser and the Association and shall expire on the first anniversary of the date of the first conveyance of a unit in the Condominium to a unit owner other than Seller. Seller shall be responsible for defects claimed by Purchaser or the Association in connection with the newly constructed general Common Elements only if a written claim reasonably specifying the breach of warranty is delivered to Seller in accordance with Section 16.1 within two (2) years following the expiration of the warranty; provided, however, that any such claim must be for a defect existing prior to the expiration of such warranty.
