General Health and Safety. 22.01 When gunite, paint removing, painting, coating, grinding, sandblasting, waterblasting, using any chemicals, or work of a dirty or dusty nature is being performed; required and approved (By Law) respiration protection and protective clothing and equipment will be provided by the Employer and shall remain the property of the employer. 22.02 The Current Occupational Health and Safety Act, Workers Compensation Act, Labour Relations Act, Employment Standards Act, and the Employment Equity Act shall be considered as part of this Agreement. 22.03 Each Employer shall provide a sanitary place of shelter (separate from the other trades and equipment) with tables and benches on any project to all employees covered under this agreement. This place of shelter shall be heated during cold weather. The Employer shall also provide a safe place for Employees to keep their tools (separate from lunchroom) and it shall be kept locked at all times when Employees take their tools out. Security during working hours shall be the responsibility of the Employees. 22.04 Properly cooled drinking water and toilet facilities shall be provided as soon as possible and municipal sanitary conditions shall be maintained, as described in the Ontario Construction Safety Act. No worker shall be required to, or shall, use a dipper or drinking cup in common with other workers. 22.05:1 The Employer agrees that all employees will be allowed a coffee break of a maximum of fifteen (15) minutes duration during the hours of work in each half of their respective working shifts. 22.05:2 The Employees shall be allowed fifteen (15) minutes time each day without loss of pay before quitting time for wash-up, clean-up, and packing tools, etc. However, employees must not leave the job site before the end of their shift.

On job sites with five (5) workers or less, paint removingany employee will report to the xxxxxxx for corrective action of any unsafe conditions which are brought to his attention and on no account shall any employees be discharged for not working under unsafe conditions.
20.02 An employee who, paintingduring working hours, coating, grinding, sandblasting, waterblasting, using any chemicalssuffers a compensable injury and is required to leave for treatment, or is sent home for such injury, shall receive payment for the remainder of the shift at his regular rate of pay.
20.03 The Employer shall, at his expense, furnish to any work person injured in his employment who is in need of it, immediate conveyance to a dirty hospital or dusty nature to a physician. It is being performed; further agreed that an ambulance shall be used where necessary and possible.
20.04 Equipment and special wearing apparel required under abnormal conditions or during inclement weather such as, but not limited to, approved fall protection, waterproof garments, safety rubber boots, coveralls and approved (By Law) respiration protection gloves, eye protectors, and protective clothing and equipment will welder’s equipment, shall be provided supplied by the Employer employer and shall remain the property of the employer.

20.08 The Union will be responsible for the delivery of provincially mandated Health and Safety programs. Such programs to be delivered include WHIMS, Confined Space, Working at Heights, Workers Health and Safety Awareness Training and Construction Health and Safety Awareness.
20.09 No personal communication devices such as cell phone, Blackberries, IPods and /or similar devices shall be used on the job during working hours
20.10 It is understood and agreed that no worker shall be referred to a site without the mandatory Health and Safety training noted in 20.08 above.
