General Information Notices & Title Reports. Once the ROW footprint has been identified, consultant will obtain and provide preliminary title reports and review title history for properties where ROW and easement acquisition is anticipated within 30 calendar days of ROW footprint being established shall be responsible for ordering and payment of preliminary title report, if needed. • Preliminary title reports may be needed for development of the legal descriptions and may need to be ordered prior to the preparation of legal descriptions. • Generation and delivery of the General Information Notice, acquisition and relocation brochures, and a copy of the applicable portion of the ROW Acquisition map (marked Preliminary and showing the parcel[s] to be purchased) to owners and occupants of affected properties. Notice is to be sent via certified mail and proof of delivery provided to the City Project Manager. Delivery of General Information Notice shall be included in the appraiser Report of Personal Interview. • If proof of delivery is not received from the post office, verbal confirmation of receipt by owner/tenant should be documented in the Report of Personal Interview. • City will record documents and pay closing costs. • Any title and escrow fees related to closing will be discussed before being incurred and billed directly to the City. All title and escrow fees will be paid directly by the City. • Up to four (4) Preliminary Title Reports and Title Reviews for properties impacted by the project within thirty (30) days of ROW phase authorization.

  • Definitions As used in this Agreement, the following terms shall have the following meanings:

  • Severability Any provision of this Agreement that is prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective to the extent of such prohibition or unenforceability without invalidating the remaining provisions hereof, and any such prohibition or unenforceability in any jurisdiction shall not invalidate or render unenforceable such provision in any other jurisdiction.
