No waiver of any provision of this Agreement is valid unless in writing, signed by the party against whom the waiver is sought to be enforced. MRZM and the SXXXXXXXXX waive each of their respective rights to a trial by jury. If any provision of this Agreement is found by a court of competent jurisdiction to be unenforceable, that provision shall be severed, and the remainder of this Agreement shall continue in full force and effect. All rights and remedies conferred under this Agreement or by law shall be cumulative and may be exercised singularly or concurrently. Failure by either party to enforce any term hereof shall not be deemed a waiver of future enforcement of that or any other term.
