GOVERNMENT OFFICIAL AND PUBLIC. “ADMINISTRATION CONCEPT” A "Public Agent or Public Official" is any individual, public servant or not, who acts in an official capacity or exercises a public post, employment or function, even if temporarily or without remuneration, in a Government Authority; an individual, public servant or not, who exercises a post, employment or function in a parastatal entity, or in a service providing company contracted or convened for the execution of an activity typical of the Public Administration; or an individual who is a director or employee of a political party, or who acts for, or on behalf of, a political party or candidate for public office. Thus, also considered Public Agents are those who exercise some activity representing the interests of any government, agency or public body, which also includes the Concessionaire. The Brazilian Penal Code has an explanatory criminal type in art. 327 establishing the concept of public official for the purposes of the criminal law: "For criminal purposes, a public official is considered to be a person who, although temporarily or without remuneration, holds a public office, job, or function.

Records of previous discipline not found in the official personnel file cannot be used against an employee in any future disciplinary proceeding. Grievances shall not be kept in the employee’s official personnel file. Employees shall be informed as to where their personnel file is maintained.
