GRIEVANCE AND ARBITRATION PROCEDURES Section A - Grievance Procedure. 12.01 The University acknowledges the right of the Union to appoint or elect Union Stewards and Union Officers and that they have the right to investigate and process grievances or potential grievances during regular working hours without loss of pay. 12.02 The University acknowledges the right of the Union to make use of Union Stewards and Union Officers to assist an employee in preparing and presenting agrievance. 12.03 The Union acknowledges that Union Stewards and Union Officers have duties to perform for the University and that they will not absent themselves unreasonably in order to attend to the grievances of employees. (a) Any employee or dismissed employee having a potential grievance will shall submit the complaint matter to the Union his/her Shop Xxxxxxx as soon as possible (normally within 10 five (5) working days) and in any case within (10) working days from the occurrence of the employee becoming aware of the occurrence or recurrence of the event giving rise to the matter at issue. The Union will decide whether Shop Xxxxxxx and the employee shall meet with the employee’s immediate supervisor and shall endeavour to proceed settle the dispute.
(b) Should no settlement ensue within five (5) working days, a grievance shall be referred, in writing, to the Department Head or Manager with a formal grievance in writing under Stage I copy to the Associate Vice- President of Human Resources.
(c) Within five (5) working days the Department Head or Manager (and, at the discretion of the grievance procedureUniversity, a representative of Human Resources) shall meet with the Shop Xxxxxxx and the employee and endeavour to settle the grievance.
(d) Should no settlement ensure within five (5) working days the matter shall be referred to the Labour Management Committee who shall endeavour to settle the dispute.

(d) Should no settlement ensure within 10 five (5) working days the matter shall be referred to the Labour Management Committee who shall endeavour to settle the dispute.
(e) Should the foregoing processes fail to settle the differences conclusively within five (5) working days of the employee becoming aware Labour Management Committee, then the matter may, in accordance with Section B, be submitted by either party to a single arbitrator. By agreement of the occurrence or recurrence parties, an Arbitration Board of the event giving rise to the issue. The Union will decide whether to proceed with three (3) persons may be appointed in lieu of a formal grievance in writing under Stage I of the grievance proceduresingle arbitrator.
