Common use of Hard Cap Freeze Clause in Contracts

Hard Cap Freeze. Effective January 1, 2015, the union agrees to a freeze of the PA 152 annual hard cap at 2014 levels (Single - $5,857.58, Two-person - $12,250, Full Family - $15,975.23). For the life of this agreement, health care increases for the HMO health plan (from the 2016-17 level) will be shared equally by the district and employees. The cost will be shared only to the extent allowed under the stipulations of PA 152 (hard cap law). For the PPO plans offered, the district will pay at the same level it paid for those plans in the 2016-17 school year. For the remaining years of the agreement, the district payment will be equal to the amount paid for the HMO plan. Should health insurance increases for the HMO exceed 10% for years two and three of the agreement, the parties agree to review plans and explore options to lower the rate(s) and/or review alternate health care plans if either party requests the review.

Should the employer cost for health care approach ten (10) percent of the hard cap levels listed above, the parties agree to discuss the currently negotiated hard cap levels. For the life of this agreement, health care increases for the HMO HRA health plan (from the 2016-17 level) will be shared equally by the district and employees. The cost will be shared only to the extent allowed under the stipulations of PA 152 (hard cap law). For the PPO all other plans offered, the district will pay at the same level it paid for those plans in the 2016-17 school year. For the remaining years of the agreement, the district payment will be equal to the amount paid does for the HMO HRA health plan. Should health insurance increases for the HMO HRA exceed 10% for years two and three of the agreement, the parties agree to review plans and explore options to lower the rate(s) and/or review alternate health care plans if either party requests the review.
