Heritage Revitalization. 1.1 The parties agree that the Heritage Lands have heritage value, deserving of protection and conservation and the Owner specifically agrees to maintain, preserve and protect the heritage character of the existing building known as the “Xxxxxx-Games House” located on the Heritage Lands in accordance with this agreement. 1.2 The parties agree that the Heritage Lands may, notwithstanding the provisions of City of Kelowna Bylaw requirements related to the existing RU1 – Large Lot Housing zoning on the Heritage Lands, be used for and developed in the following manner, and in accordance with the further provisions of this agreement: a) Lot A may be subdivided to create two lots, in accordance with Appendix “A” attached to this agreement, each of which will retain the RU1-Large Lot Housing zoning designation. b) A maximum of one Single Detached House will be permitted per newly created lot. c) The Xxxxxx-Games House will be relocated to Lot 1, as shown on Appendix “A”. d) A Single Detached House will be constructed on Lot 2, as shown on Appendix “A”, and generally in accordance with the plans and design outlined in Appendix “B” attached to this agreement. e) The Owner will apply for formal designation of the Xxxxxx-Games House as a protected heritage property pursuant to the City of Kelowna Heritage Procedures Bylaw No. 7776 and Section 967 of the Local Government Act. A Housing Agreement will be relocated registered on title which protects the affordable rental housing in the secondary suite for a period of 10 years from the date of registration.
d) The Owner will be permitted to Lot 1register an easement over the newly created lot which will allow the encroachment of a wheelchair ramp which will provide access to the Heritage Building. Should the Owner remove the handicapped ramp (except temporarily for repair or replacement) the easement will cease to exist.
e) A single detached house will be constructed on the newly created unoccupied lot, as shown on Appendix “A”.

(a) The adaptive reuse of the house as a gift shop provided that:
(i) The hours of operation for all enterprises located on the subject property shall take place between 9:00am to 6:00pm, and Mondays through Saturdays;
(ii) The number of staff operating from the Heritage Building is limited to a maximum of three;
(iii) One free standing sign not exceeding 0.23m² (2.5ft²) be permitted in accordance with the further provisions “County Cottage Gifts & Décor” sign depicted on Schedule “BB”;
(iv) The maximum floor area of this agreementthe commercial space be limited to 200m²;
(v) Six on-site parking stalls shall be provided. Two on-site stalls shall be reserved for customers at all times. Two of the residential on-site parking stalls will be grass crete.
(b) Two residential dwelling units, including:
a) Lot A may be subdivided to create two lots, in accordance with Appendix “A” attached to this agreement, each of which will retain the RU1-Large Lot Housing zoning designation.
b) A maximum of one Single Detached House will be permitted per newly created lot.
c(i) The Xxxxxx-Games House will be relocated to Lot 1, as shown on Appendix “A”.conversion of the basement into a residential suite;
d) A Single Detached House will be constructed on Lot 2, as shown on Appendix “A”, and generally in accordance with the plans and design outlined in Appendix “B” attached to this agreement.

(c) No dwelling units shall be developed in the following manner, and in accordance with the further provisions of heritage building without an application to amend this heritage revitalization agreement:;
a) Lot A may be subdivided to create two lots, in accordance with Appendix “A” attached to this agreement, each of which will retain the RU1-Large Lot Housing zoning designation.
b) A maximum of one Single Detached House will be permitted per newly created lot.
c(d) The Xxxxxx-Games House Owner will be relocated to Lot 1, as shown on Appendix “A”.not undertake any interior renovations that would compromise the future residential viability of the heritage building;
d) A Single Detached House will be constructed on Lot 2, as shown on Appendix “A”, and generally in accordance with the plans and design outlined in Appendix “B” attached to this agreement.
(e) The Owner will apply for formal designation shall maintain the landscaping in a condition as close to possible as currently exists on the property;
(f) The structure and form and character of the Xxxxxx-Games House house will remain as a protected heritage property pursuant to shown on the City of Kelowna Heritage Procedures Bylaw No. 7776 site plan/survey attached as Schedule “A” and Section 967 of the Local Government Act.
