How Will the Attorneys for the Class and the Class Representative Be Paid. The attorneys for Plaintiffs and the Class will be paid from the Gross Settlement Amount. Subject to Court approval, the attorneys for Plaintiff and the Class shall be paid an amount not to exceed one-third of the Gross Settlement Amount (or $249,999.99) for attorney fees and up to $10,000 for litigation costs. The Plaintiffs will also be paid a Class Representative Enhancement Payment, up to $7,500.00 each, subject to Court approval.

How Will the Attorneys for the Class and the Class Representative Be Paid. The attorneys for Plaintiff and the Class will be paid from the Gross Settlement Amount. Subject to Court approval, the attorneys for Plaintiff and the Class shall be paid an amount not to exceed thirty-five percent (35%) of the Maximum Settlement Amount (or $70,000) for attorneys’ fees and up to $20,000 for litigation costs. Defendant has paid all its own attorneys’ fees and costs. As set forth in Section No. 10 above, Plaintiff will also be paid a Class Representative Enhancement Payment, subject to Court approval.
