Common use of Incomplete Development Clause in Contracts

Incomplete Development. Purchaser acknowledges that the Resort is located in an area that is subject to on-going construction activities relating to the development, construction and renovations on or about the area known as One River Run in general (collectively, the “Construction Activities”). The Construction Activities are expected to generate an unpredictable amount of visible, audible and odorous impacts and disturbances. The Construction Activities may include, without limitation: (x) construction traffic, including without limitation, construction vehicles, equipment and vehicles traveling on the roads within Keystone Neighbourhood; and (y) construction activities including, without limitation, grading, excavation, clearing, site work and construction of improvements relating to nearby properties or the Mountain Recreational Areas.
