Inconsistent law. To the extent permitted by law, this agreement prevails to the extent it is inconsistent with any law.

Inconsistent law. 19.1 To the extent permitted by law, the Agreements prevail to the extent they are inconsistent with any law:
a) If there are any inconsistencies between this Client Agreement and the PDS, the PDS will prevail.
b) A provision of the Agreements that is void, illegal or unenforceable is ineffective only to the extent of the voidness, illegality or unenforceability, but the remaining provisions are not affected.
c) Rights given to Rakuten Securities Australia under the Agreements and the Client’s liabilities under the Agreements are not affected by anything, which might otherwise affect them at law.
d) Any present or future legislation which operates to vary the Client’s obligations in connection with the Agreements with the result that Rakuten Securities Australia’s rights, powers or remedies are adversely affected (including by way of delay or postponement) is excluded except to the extent that its exclusion is prohibited or rendered ineffective by law.
Inconsistent law. To the extent permitted by law, each Bank Finance Document prevails to the extent it is inconsistent with any law.
Inconsistent law. 43.1 To the extent permitted by law, this document prevails to the extent it is inconsistent with any law.
43.2 If the Superannuation Industry (Supervision) Xxx 0000 (Cth) prohibits you from mortgaging or charging any of the secured property, this document does not extend to that secured property.
43.3 If any term, agreement, or condition of this document or the application of any term, agreement or condition of this document to any person or circumstances is or becomes, illegal, invalid or unenforceable in any jurisdiction it will be varied to the extent necessary to render it no longer illegal, void or unenforceable, or if necessary it will be severed and neither the remaining terms, agreements and conditions nor the application, validity or enforceability of the severed term, agreement or condition in any other jurisdiction will be affected.
(c) given by any other means permitted by law. Your local branch may be able to provide details of how your notice can be sent to us (including an email or other electronic address) but your local branch may not be authorised to receive the notice on our behalf. To ensure it is dealt with correctly, any notice should always be addressed to our registered office.

Any present or future legislation which operates to vary the obligations of a Party in connection with this Agreement with the result that another Party’s rights, powers or remedies are adversely affected (including, by way of delay or postponement) is excluded except to the extent that its exclusion is prohibited or rendered ineffective by Law. Where this Agreement contemplates that a Party may agree or consent to something (however it is described), that Party may: agree or consent, or not agree or consent, in its absolute discretion; and agree or consent subject to conditions, unless this Agreement expressly contemplates otherwise.
