Inconsistent Name and Account Number. If Customer or third party acting on Customer’s instruction initiates a fund transfer instruction or Payment Order to Bank that describes the Beneficiary to receive the proceeds of such fund transfer instruction or Payment Order, the Beneficiary’s bank, or an intermediary bank by name and an account or other identifying number, Bank and subsequent parties to the fund transfer instruction or Payment Order may rely on and act solely on the basis of such number, even though the name and number do not agree and even though Bank and subsequent parties know or have reason to know of the inconsistency. Customer’s obligation to pay the amount of the fund transfer instruction or Payment Order to Bank is not excused in such circumstances.

Inconsistent Name and Account Number. If any Payment Order by Client describes the intended recipient of funds inconsistently by name and account number, Client agrees that payment by the receiving bank (which may be Bank) may be made on the basis of the account number alone even if that account is not owned by the person or entity named in the Payment Order. If any Payment Order identifies an intermediary bank or the payee’s bank inconsistently by name and account number, Client agrees that Bank may rely solely on the account number as the proper identification of the intermediary bank or the payee’s bank even if it identifies a bank different from the bank Client identified by name. To the extent permitted by Applicable Law, Client acknowledges and agrees that its obligation to pay Bank the amount of the Transfer pursuant to a Payment Order will not be excused in any circumstance for the erroneous Payment Order of Client and that Client will reimburse Bank for any losses or expense Bank incurs as a result of Bank’s reliance on the account number provided in Payment Order.
Inconsistent Name and Account Number. If a fund transfer instruction for credit or debit from your account lists the name or account number of the beneficiary, the name or routing and transit number of beneficiary’s bank or any intermediary bank in an inconsistent or incorrect manner, payment may be made by relying upon the account number, even if it identifies a different person or bank from the one named in the instructions received. You agree that we have no obligation to verify whether the name and the number refer to the same person.
Inconsistent Name and Account Number. Customer is responsible for the contents of each Payment Order delivered to Centier by Customer or on Customer’s behalf. Customer acknowledges and agrees that Centier and any receiving bank may rely on the account number (or bank identification number) which appears in any Payment Order issued by Customer or on Customer’s behalf without any obligation to look at the name of the receiving person, bank or account which may also appear on the Payment Order, even if that number identifies a person, bank or account different from the person, bank or account identified by name. Unless otherwise provided by applicable law or regulation, if Customer originates a Payment Order containing an inconsistent name and account number (or bank identification number), Customer acknowledges and agrees that Customer will be obligated to pay Centier the amount of the Transfer originated by Centier on the basis of that Payment Order.
Inconsistent Name and Account Number. Customer acknowledges and agrees that, if an Entry describes the Receiver inconsistently by name and account number, payment of the Entry transmitted by the Bank to the RDFI may be made by the RDFI (or Bank in the case of an On-Us Entry) on the basis of the account number supplied by Customer, even if it identifies a person different from the named Receiver, and that Customer’s obligation to pay the amount of the Entry to the Bank is not excused in such circumstances.

If any Wire Transfer request by the Customer describes the intended recipient of funds inconsistently by name and account number, the Customer agrees that payment by the receiving bank (which may be the Bank) may be made on the basis of the account number alone even if that account is not owned by the person or entity named in the Wire Transfer request. If any Wire Transfer request identifies an intermediary bank or the payee’s bank inconsistently by name and identifying number, the Customer agrees that the Bank may rely solely on the identifying number as the proper identification of the intermediary bank or the payee’s bank even if it identifies a bank different from the bank the Customer identified by name. To the extent permitted by applicable law, the Customer acknowledges and agrees that its obligation to pay the Bank the amount of the Wire Transfer pursuant to a Wire Transfer request will not be excused in any circumstance described in Section 21 (Erroneous Instructions), below, and that the Customer will reimburse the Bank for any losses or expenses the Bank incurs as a result of the Bank’s reliance on the identifying number provided in the Wire Transfer request.
Inconsistent Name and Account Number. If a payment order received by the Bank identifies a beneficiary or the Beneficiary Bank only with an identification number, You authorize the Bank to accept only the identification number of the beneficiary or Beneficiary Bank, without making any other inquiry. If the request identifies the beneficiary or Beneficiary Bank by name and account number, the Bank may accept only the number as the appropriate identification, even if the number is associated with a name other than the name of the person or bank identified by name. The Bank shall also have the option, in that case, of returning the funds to the remitter. You agree that the Bank shall not be responsible for any delay that arises from the Bank’s efforts to reconcile the inconsistencies between the account name and number, or for investigating if it suspects irregularities.
