Independence of the Seller. The Seller shall act as an independent contractor with respect to the Work and shall exercise control, supervision, management and direction as to the method and manner of obtaining the results required by the Purchaser, but shall never be deemed a member of the Purchaser Group nor act on behalf of the Purchaser.

Status of Purchaser Purchaser enters into the Agreement for itself and as agent for and on behalf of the other Co-Venturers. Notwithstanding the above, all losses, damages, costs (including legal costs) and expenses recoverable by Purchaser pursuant to the Agreement, or otherwise shall include the losses, damages, costs (including legal costs) and expenses of Purchaser’s Co-Venturers and its and their respective Affiliates expect that such losses, damages, costs (including legal costs) and expenses shall be subject to the same limitations or exclusions of liability as are applicable to either Party under the Agreement. For the avoidance of doubt, any and all limitations of Seller’s liability set out in the Agreement shall represent the aggregate cumulative liability of the liability of the Seller Group to the Purchaser Group.
