Industrial Insurance Waiver. With respect to the performance of this Agreement and as to claims against the County, its appointed and elected officers, agents and employees, the Contractor expressly waives its immunity under Title 51 of the Revised Code of Washington, the Industrial Insurance Act, as now or hereafter amended, for injuries to its employees and agrees that the obligations to indemnify, defend and hold harmless provided in this Agreement extend to any claim brought by or on behalf of any employee of the Contractor. Along with the other provisions of this Agreement, this waiver is mutually negotiated by the parties to this Agreement.

This provision does not waive any of L&I’s rights to collect from the Contractor.

County may deduct the amount owed by LEDC to the accident fund from the amount payable to LEDC by County under this MOU, and transmit the deducted amount to the Department of Labor and Industries, (L&I) Division of Insurance Services. This provision does not waive any of L&I’s rights to collect from LEDC.
Industrial Insurance Waiver. Consultant expressly waives any claim of defense against the Port as may be provided by the Industrial Insurance Act, RCW51.04.010 et seq. for any claim asserted by any person (or relative or estate thereof) for injury or death sustained during the course of the Contract Work.

In any action against Owner and any other Person indemnified in accordance with this Article 17, by any employee of Contractor, Subcontractors, Lower-tier Subcontractors, agents, or anyone directly or indirectly employed by any of them, the indemnification obligation of this Article 17 shall not be limited by a limit on the amount or type of damages, compensation, or benefits payable by or for Contractor or any Subcontractor or Lower-tier Subcontractor under the Georgia Workers' Compensation Act, or any other employee benefit acts. In addition, 105 Article 17 Contractor waives any immunity provided under the Georgia Workers' Compensation Act; however, such waiver shall be effective only as to Owner and any other indemnitees and not as to any employee of Contractor, Subcontractors, Lower-tier Subcontractors, agents or anyone directly or indirectly employed by any of them. This provision has been mutually negotiated by the parties.

With respect to the performance of this Agreement and as to claims against the COUNTY, its Additional Insureds, officers, agents and employees, XXXXXXX and his firm expressly waive any immunity under Title 51 of the Revised Code of Washington, the Industrial Insurance Act, for injuries to the firm’s employees, and agree that the obligations to indemnify, defend and hold harmless provided in this Agreement extend to any claim brought by or on behalf of any employee of XXXXXXX and his firm. This waiver is mutually negotiated by the parties to this Agreement.
