Infractions Committee. 4 The President shall appoint an infractions committee (the “Committee”) as necessary to 5 ensure fair, consistent and appropriate enforcement of this Agreement, the Harvesting 6 Rules, the Plan and other Sector requirements as adopted under the terms of this 7 Agreement and the Sector’s Bylaws. 9 The Committee will be comprised of at least three Board members excluding any Board 10 member who may be subject to investigation. Such Committee member assignments 11 shall be rotated. 13 The Committee shall recommend as necessary to the Board for its approval a schedule of 14 penalties, which shall be similar in form to Exhibit A (the “Schedule of Penalties”), for 15 any unauthorized fishing activities (whether under applicable laws, rules and regulations 16 or otherwise) and for violations of this Agreement, the Harvesting Rules, the Plan and 17 other Sector requirements as may be adopted under the terms of this Agreement or the 18 Sector’s Bylaws. 20 In addition, the Committee shall have the authority to take any number of enforcement 21 measures against the Members for the non-payment of membership dues and/or 22 poundage fees. Such enforcement measures may include expulsion of the violating 23 Member under Section 3 and /or issuing a “stop fishing” order against such Member.
