Insolvency of Employer. As used in this Article X, the Employer shall be deemed to be "Insolvent" if (a) the Employer is unable to pay its debts as they come due, or (b) the Employer is subject to a pending proceeding as a debtor under the United States Bankruptcy Code (or any successor federal statute). In the event that the Employer shall be deemed Insolvent, the assets of the Trust Fund shall be held for the benefit of the general creditors of the Employer (hereinafter referred to as "Bankruptcy Creditors").
