INSURANCE PLAN, PROVIDER, AND ADMINISTRATOR. To ensure that Xxxxxx Street can continue to provide cost-effective insurance, Xxxxxx Street reserves the right to select the insurance plans, the plan design/benefits, the insurance providers, and if applicable, the plan administrators for its health, dental, life, and short-term and long-term disability insurance plans, provided they are substantially similar to benefit levels provided under the current plans. In the event of a change in health and dental insurance, similarity shall be determined by comparison of benefit coverage, deductibles, out-of-pocket expenses, and co-insurance under the current PPO health insurance plan and dental insurance plan. Xxxxxx Street will consult with the Union prior to instituting any change.

  • Management and Administration 5.1 TxDOT Responsibility for Policy Decisions All policy decisions regarding use, operation and maintenance of the Project shall rest solely with TxDOT.

  • Independent Contractor; Workers’ Compensation Insurance The Contractor is performing as an independent entity under this Contract. No part of this Contract shall be construed to represent the creation of an employment, agency, partnership or joint venture agreement between the parties. Neither party will assume liability for any injury (including death) to any persons, or damage to any property, arising out of the acts or omissions of the agents, employees or subcontractors of the other party. The Contractor shall provide all necessary unemployment and workers’ compensation insurance for the Contractor’s employees, and shall provide the State with a Certificate of Insurance evidencing such coverage prior to starting work under this Contract.

  • Long Term Disability Insurance Plan The Employer shall provide a mutually acceptable long-term disability insurance plan, a copy of which shall appear in Appendix “A” – Long-Term Disability Insurance Plan. The plan shall provide post-probationary regular employees with salary continuation as per Appendix “A” until age sixty-five (65) in the event of a disability. The cost of the plan shall be borne by the Employer.
