Common use of Interconnection and Delivery Services Clause in Contracts

Interconnection and Delivery Services. (a) Seller shall be responsible for all costs associated with interconnection of the Facility at the Interconnection Point, including the costs of the Network Upgrades, consistent with all standards and requirements set forth by the FERC, ISO-NE, any other applicable Governmental Entity and the Interconnecting Utility. (b) Seller shall defend, indemnify and hold Buyer harmless against any liability arising due to Seller’s performance or failure to perform under the Interconnection Agreement.

Interconnection and Delivery Services. (a) Seller shall be responsible for all costs associated with interconnection of the Facility at the Interconnection Point, including the costs of the Network Upgrades, Point consistent with all standards and requirements set forth by the FERC, ISO-NE, any other applicable Governmental Entity Entity, and under the Interconnecting Utility. (b) Interconnection Tariff. Seller shall defend, indemnify and hold Buyer harmless against any liability arising due to Seller’s performance or failure to perform under the Interconnection AgreementAgreement or the Interconnection Tariff.

(b) Seller shall defend, indemnify and hold Buyer harmless against any liability of Seller arising due to Seller’s performance or failure to perform under the Interconnection Agreement.

(a) Seller shall be responsible for all costs associated with interconnection of the Facility at the Interconnection Point, including the costs of the Network Upgrades, consistent with all standards and requirements set forth by the FERC, ISO-NE, any other applicable Governmental Entity and the Interconnecting Utility., subject to the Interconnection Cost Adjustment set forth in Exhibit E. (b) Seller shall defend, indemnify and hold Buyer harmless against any liability of Seller arising due to Seller’s performance or failure to perform under the Interconnection Agreement.

Interconnection and Delivery Services. (a) ‌ Seller shall be responsible for all costs associated with interconnection of the Facility at the Interconnection Point at a level that is capable of satisfying the Capacity Capability Interconnection Standard under the ISO-NE Rules and with Delivery of the Energy at the Delivery Point, including the costs of the Network Upgrades, consistent with all standards and requirements set forth by the FERC, ISO-NE, any other applicable Governmental Entity and the Interconnecting Utility. (b) Utility and other Transmission Providers. Seller shall defend, indemnify be responsible for procuring delivery service and hold Buyer harmless against any liability arising due to Seller’s performance or failure to perform under the Interconnection Agreementall costs associated with it.
