Interest and Late Fees. ADVERTISING PROVIDER shall pay a penalty for late or delinquent payments accruing out of this Agreement, whether Annual License Fee or otherwise, of eighteen percent (18%) per annum or 1 . 5 % p e r m o n t h on the balance of the unpaid amount, calculated from the date the amount was due until the close of the Business Day upon which the delinquent payment was received by CITY.
Interest and Late Fees. In the event Tenant should fail to pay to Landlord any Rent or other charge when due, Tenant shall pay to Landlord (a) interest on the unpaid amount from the due date through the date of payment, in an amount equal to ten percent (10%) per annum; plus (b) a late fee for Landlord’s increased administrative expenses, in an amount equal to one percent (1%), per month, of the amount owed Landlord. Tenant acknowledges that Landlord’s actual damages for late payments and returned checks may be difficult or impractical to fix; and therefore, Tenant further acknowledges that such estimated fees and charges are fair and reasonable liquidated damages.

The exercise of any remedy by Landlord shall not be deemed an election of remedies or preclude Landlord from exercising any other remedies in the future.
