Section 3.6. 2 Neither the District, nor the Association, shall discriminate against any employee subject to this 3 Agreement on the basis of race, color, religion, sex (including pregnancy, gender identity, and sexual 4 orientation), national origin, age (40 or older), disability or genetic information with respect to an individual 5 without danger to the health or safety of the physically disabled person or others.
Section 3.6. 6 In the event the supervisor believes the employee’s performance needs improvement, the supervisor 7 and the employee shall jointly develop a written plan of improvement. Once the plan is written, the 8 employee will have 30-90 calendar days to demonstrate improvement as laid out in the plan or he/she 9 may be subject to progressive discipline.
Section 3.6. 15 Employees subject to this Agreement have the right to have Association representatives or other persons 16 present at discussions between themselves and supervisors or other representatives of the District as 17 hereinafter provided.
Section 3.6. 11 Any materials filed longer than two (2) years in the personnel file shall, at the employee's request, be 12 removed, provided the materials are not required to be retained by law, and provided further, that the 13 District may keep documents regarding allegations of physical or sexual abuse, other sexual 14 misconduct, harassment, or misconduct involving students or other children for more than two (2) 15 years if these documents are kept in a separate, sealed file within the employee's personnel file.

Section 3.6. 2 Employees assigned duties for a student with diabetes under the parameters of RCW 28A.210.330 (2) 3 (a, b) shall be provided the training and right of refusal as described in the respective code and District 4 Policy.
Section 3.6. 8 There shall be only one (1) personnel file for each employee. These files shall be kept in the 9 Superintendent’s office and employees shall be permitted to inspect these files upon request to the 10 Superintendent and/or the Superintendent’s designee. At the request of the employee and at employee 11 expense, a copy of each item placed in the personnel file shall be provided the employee within ten (10) 12 working days of said request. No materials concerning grievances shall be added to this file unless 13 requested by the employee. 15 No evaluation, correspondence, or any material making any derogatory references to anything other than 16 an employee’s work performance or their ability to perform their job shall be placed in the personnel file, 17 the author (source) of any material must be identified on the material. In the event that derogatory 18 remarks as permitted above are placed in any employee’s personnel file, the affected employee shall be 19 notified prior to its inclusion and shall be allowed to attach written comments to the item(s) being 20 included. 22 Employees who wish documents removed from their personnel file shall submit a written request to the

At the 45 written request of an employee, items of concern may be removed after three (3) years at the 46 supervisor’s discretion.
