Licensee may not permit any software products not licensed by OT to interface or interact with the Software, unless accomplished through the use of application program interfaces provided by OT. 製、送信、販売、リース、ライセンス許諾、サブライセンス許諾、公開、実演、再分配もしくは担保設定を行うこ と、(b)サービス・ビューローのため、またはタイムシェアリングの目的で本ソフトウェアの貸出、貸付または使用を 行うか、あるいは、その他の個人や法人に対して、本ソフトウェアへのリンクの作成、またはほかのサーバー、無線デバイスやインターネットベースのデバイスへの本ソフトウェアの「フレーム」や「ミラー」を許可するか、またはその他の方法での本ソフトウェアの入手、使用もしくは活用を第三者に認めること、(c)本ソフトウェアの全てまたは一部を使って、競争製品を作り出すこと、(d)本ソフトウェアへのアクセスあるいは使用について、第三者に料金を請求すること、または(e)本ソフトウェアをライセンス文書と矛盾した方法で使用することをせず、他の者がこれらを行うのを認めません。 5.2 更なる制限 ライセンス取得者は、本ソフトウェアに関して行われたあらゆるベンチマークまたは運用、評価その他のテストの結果を、公開または開示しないものとします。ライセンス取得者は、本ソフトウェアが耐障害性のものでなく、フェイルセーフ性能を必要とする危険な環境でのオンライン制御機器として設計されておらず、製造されておらず、かかるオンライン制御機器としての使用もしくは再販売が意図されていないことを了承したうえ、(w)航空機、航空交通、航空機操縦、もしくは航空通信のオンライン制御、(x)あらゆる核施設の設計、建設、創業あるいは管理、(y)医療あるいは外科的な応用事例、または(z)失敗によって個人の傷害または死亡の原因となり得るその他の応用事例において、本ソフトウェアを使用しないものとします。準拠法の下で明示的に許可されている場合を除き、ライセンス取得者は、本ソフトウェアのソースコードもしくは基盤となる構造、アイデアもしくはアルゴリズムまたは何らかの機密情報もしくは企業秘密の変更、改作、翻訳、リバースエンジニアリング、逆コンパイル、逆アセンブルを行わないものとします。 5.3 派生著作物 / 改善 ライセンス取得者は、本ソフトウェアに対する変更、翻 訳、翻案、編曲、追加、修正、拡張、アップグレード、アップデート、改善（特許取得の対象となる修正を含む）、新バージョン、またはその他の派生著作物を作成するために本ソフトウェアを使用することはできません。前述の規定にかかわらず、本ソフトウェアの一部がライセンス取得者にソースコードフォーマット(または変更可能なその他のフォーマット)で提供される場合、ライセンス取得者は本 EULA に従って、本ソフトウェアを使用する目的にかぎ り、本ソフトウェアの当該部分を修正することができ、OTがすべての修正部分を単独で所有し、ライセンス取得者は当該修正部分に関する全世界、かつ恒久的な知的財産権及びその他の財産権のすべてを、取消不能の形で OT に譲渡します。 5.4 インターフェイス用および対話型ソフトウェア ライセンス取得者は、OT によって提供されるアプリケーションプログラムインターフェイスを用いて達成される場合を除き、OT によって使用を許諾されていないソフトウェア製品を本ソフトウェアとインターフェイスし、または相互に作用することを認めない場合があります。
