Interim Obligations upon a Finding of Unforeseen Circumstances. If the Wildlife Agencies make a finding of Unforeseen Circumstances with regard to a Federal Listed Covered Species, during the period necessary to determine the nature and location of additional or modified mitigation, PSE will avoid contributing to an appreciable reduction in the likelihood of the survival and recovery of the affected species. As described in Section 15.2.2 and Section 15.3.2 of the IA, the Wildlife Agencies shall be responsible for implementing such additional measures or modifications, unless PSE consents to do so.

If any Wildlife Agency makes a finding of unforeseen circumstances, during the period necessary to determine what actions, if any, are available to address such circumstances, MRC shall consult with that Wildlife Agency and will avoid implementing any Covered Activity within the Plan Area that the Wildlife Agency determines, in consultation with MRC, would appreciably reduce the likelihood of the survival and recovery of a Covered Species.

If either Wildlife Agency finds that an Unforeseen Circumstance has occurred with regard to a Covered Species and that additional measures may be required for the Covered Species as a result, during the period necessary to determine the nature, scope and location of any additional measures, the Permittee will avoid causing an appreciable reduction in the likelihood of the survival and recovery of the affected species. The Permittee will not be responsible for implementing any additional measures contrary to the regulatory assurances provided under the No Surprises Rule or the NCCPA unless the Permittee consents to do so.
