Interpreter Differential Clause Samples
The Interpreter Differential clause defines how discrepancies in interpretation between different language versions of a contract are resolved. Typically, this clause specifies which language version prevails in the event of a conflict, ensuring that all parties understand which text is authoritative. For example, in bilingual contracts, the English version may be designated as the controlling document if inconsistencies arise. This clause's core function is to prevent misunderstandings and legal disputes by clearly establishing a hierarchy among language versions, thereby ensuring clarity and certainty in contractual obligations.
Interpreter Differential. Nurses shall be eligible to receive an interpreter pay differential in accordance with Medical Center policy. To be eligible for this differential, an employee must consistently use interpreter skills on the job at least 15% of the employee’s working time and pass the qualifying language proficiency examination. Occasional interpreting during the normal course of work does not qualify for the interpreter differential. The amount of such differential shall be 7% of the nurse’s straight rate of pay.

Employees who pass a Medical Terminology bi-lingual competency test that is approved by the Employer shall be eligible to receive an interpreter pay differential in accordance with Medical Center policy. The person receiving the differential must demonstrate fluency by the written or oral language competency test administered through the TPS Title III Office. Individuals who have been approved and passed the fluency test for speaking (interpreting) will be paid $.50 per hour. Individuals who have been approved and passed the fluency test for writing (translating) will be paid $.50 per hour.
