INTERVENTION OF SPOUSE. (, spouse of the Borrower, domiciled and residing at (, intervenes in this Contract and declares: that he/she has taken cognizance of this Contract and consents thereto; that the declaration of matrimonial status made by the Borrower is accurate; that, even if a declaration of family residence has previously been or will subsequently be registered against the Property, his/her rights are subordinated to those of the Lender and the Lender may exercise its rights and recourses, free of all rights of the intervening spouse; and that if a right of use or ownership in the Hypothecated Property is granted in his/her favour, he/she will be solidarily liable for all of the Indebtedness, without the benefits of division or discussion. INTERVENTION OF SPOUSE. Where rendered necessary by the Seller’s matrimonial regime, the Seller shall provide to the Buyer, as soon as this offer to purchase is accepted, his spouse’s written consent, and, where applicable, his spouse’s concurrence and undertaking to intervene in the deed of sale for the same purpose, failing which the Buyer may render this offer to purchase null and void by giving written notice to that effect.
INTERVENTION OF SPOUSE. If part of the IMMOVABLE constitutes the SELLER’s family residence, or where rendered necessary by the SELLER’s matrimonial status, the SELLER undertakes to remit to the BUYER, as soon as this promise to purchase is accepted, either a document evidencing his spouse’s consent and, where applicable, his spouse’s concurrence and an undertaking by his spouse to intervene for the same purposes in the notarial deed of sale, or a copy of a judgment authorizing him to sell the IMMOVABLE without his spouse’s consent. Failing that, the BUYER may, by giving written notice to that effect, render this promise to purchase null and void.
