Inventory of Hazardous Materials. The Builder shall provide the Buyer with an Inventory of Hazardous Materials (“IHM”) and an IHM Certificate in accordance with Regulation (EU) No. 1257/2013 of the European Parliament and of the Council of 20 November 2013 on Ship Recycling and the Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships.

Inventory of Hazardous Materials. Each Borrower shall ensure that the Ship owned by it maintains a valid and up to date Inventory of Hazardous Materials (IHM) which is certified in accordance with the EU Ship Recycling Regulation, 2013 and/or the International Maritime Organisation’s (IMO) Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships, 2009 as further described by IMO and/or that Ship’s Approved Classification Society.

Failure to maintain either the safety documents or labels will be considered an event of default and will be subject to remedies applied by the Sublessor as described therein Section 20.
