Irrecoverable Faults Sample Clauses

The Irrecoverable Faults clause defines specific types of failures or breaches that cannot be remedied or cured by the responsible party. In practice, this clause typically lists certain actions or omissions—such as gross negligence, willful misconduct, or repeated violations—that, once they occur, immediately trigger consequences like contract termination or liability, regardless of any attempts to fix the issue. Its core function is to clearly identify situations where the contract relationship must end or shift due to serious, non-repairable problems, thereby protecting parties from ongoing risk or harm caused by severe breaches.
Irrecoverable Faults. The Merchant Transmission Facility shall not be required to recover from the following:  Permanent faults within the protection zones of the converter station including faults on the 230kV and 345kV cable systems between the converter station and the PSE&G Substation and between the ▇▇▇▇ ▇▇▇▇ ▇▇▇▇▇▇ 345kV Substation, respectively;  Any event for which the short-circuit capacity at ▇▇▇▇ ▇▇▇▇ ▇▇▇▇▇▇ 345kV Substation is reduced below the minimum post-contingency value.
