Issuance of NCCP Authorization. Concurrent with the Effective Date, the CDFG will issue its approval of the Subarea Plan and a NCCP Authorization which authorizes the Incidental Take of Covered Species Subject to Incidental Take in the Subarea, subject to the terms of the MSCP, the Subarea Plan, this Agreement, and the NCCP Authorization. As to any Covered Species Subject to Incidental Take that is not listed as threatened or endangered under the CESA as of the Effective Date, the NCCP Authorization shall automatically become effective with respect to such species concurrently with its listing as threatened or endangered under the CESA or its acceptance by the California Fish and Game Commission as a candidate for such listing. The NCCP Authorization will be effective for 50 years. The NCCP Authorization will be renewable utilizing the applicable procedures in effect at the time of renewal.

Issuance of NCCP Authorization. CDFG will approve the RPV NCCP Subarea Plan and a issue a NCCP Act Authorization that authorizes the Take of RPV Covered Species and Species Adequately Conserved in the Subarea, subject to the terms of, and consistent with, the RPV NCCP Subarea Plan and this Agreement. The NCCP Act Authorization will take effect on the Effective Date and be effective for 50 years unless it is terminated, suspended or revoked sooner. The NCCP Act Authorization will be renewable utilizing the applicable procedures in effect at the time of renewal.

The required certificates must be filed with the Owner and copied maintained by the Contractor as of the beginning date of this contract and each subcontract, supplier contract, or consultant contract, and upon final payment to the subcontractor or consultant. State officials, including officials of the Georgia Department of Audits and Accounts, officials of the Owner, retain the right to inspect and audit the Project Site and employment records of the Contractor, subcontractors and consultants without notice during normal working hours until Final Completion, and as otherwise specified by law and by Rules and Regulations of the Georgia Department of Audits and Accounts.
