Late Payments and Penalties. As stated in Sections 3.2 and 3.5 of this Article, Xxxxxx remittance of the SBA Form 1502 and the funds collected are due to FTA by the FTA Due Date. POSTMARKS ARE NOT CONSIDERED AS PROOF OF RECEIPT. THE REQUIREMENT IS RECEIPT BY FTA. If Lender remittance, including complete payment information as specified in Section 3.5 of this Article is not received in the office of the FTA by 5 PM Eastern Time on the second business day after the FTA Due Date, Lender shall pay a late payment penalty to SBA (collected by FTA), which is the greater of: (a) $100; or (b) five percent (5%) of the unremitted amount subject to a $5,000 per month per reporting unit limit for the penalty. If this penalty fee is not included in the Lender remittance, FTA, on behalf of SBA, shall levy such late payment penalty on Lender. Failure by Xxxxxx to pay such penalty and collection fees within ten (10) business days of receipt of a bill for such fees may constitute a significant violation of SBA Loan Program Requirements. FTA and SBA reserve the right to withhold these penalty fees from settlement of any future Guaranteed Interest sale, or any payment made by SBA or FTA to Lender. FTA will forward the fees due SBA on a regular basis, no less frequently than monthly, pursuant to FTA’s contract with SBA.

Late Payments and Penalties. Any late fees will be incurred by the person(s) making the late payments. If any one individual, either by doing something (e.g., causing damage) or failing to do something (e.g., failing to make rent or utility payments), causes any other individual to pay more than their share of ONE/ (1/number of tenants) the expense, that individual will be financially liable to the others for their expenses.
Late Payments and Penalties. The charge for late payments is five percent (5%) of any rental or other payment due under the Lease which is not paid within ten (10) days after said payment is due. In the event the lessee ceases to pay insurance, tax or maintenance expenses, etc. Lessor may pay these expenses and charge lessee for these costs, plus interest at eighteen percent (18%) per annum until repaid to Lessor.

  • Fines and Penalties Qwest shall be liable to pay to CLEC fines and penalties for resold services in accordance with the Commission's retail service requirements that apply to Qwest retail services, if any. Such credits shall be limited in accordance with the following: a) Qwest's fines and penalties paid to CLEC shall be subject to the wholesale discount; b) Qwest shall only be liable to provide fines and penalties in accordance with the resold services provided to CLEC.   • Payment of Stipulated Penalties EPA may send Purchaser a demand for stipulated penalties. The demand will include a description of the noncompliance and will specify the amount of the stipulated penalties owed. Purchaser may initiate dispute resolution under Section XIII regarding the demand. Purchaser shall pay the amount demanded or, if Purchaser initiates dispute resolution, the uncontested portion of the amount demanded, within 30 days after receipt of the demand. Nothing in this Settlement limits the authority of the United States: (a) to seek any remedy otherwise provided by law for Purchaser’s failure to pay stipulated penalties or interest; or (b) to seek any other remedies or sanctions available by virtue of Purchaser’s noncompliance with this Settlement or of the statutes and regulations upon which it is based including penalties under section 106(b) of CERCLA provided, however, that the United States may not seek civil penalties under section 106(b) for any noncompliance for which a stipulated penalty is provided herein, except in the case of a willful noncompliance with this Settlement or in the event that EPA assumes performance of a portion or all of the Work pursuant to ¶ 30 (Work Takeover).   • Late Payment Penalty When a Member or a Specified Corporate User neglects to fulfill the executing monetary obligations under this Agreement, or an Individual Contract, the Member or a Specified Corporate User shall pay the delayed payment to DBS at an annual rate of 14.6% on a pro rata basis (calculated on a daily basis with a year being equal to 365 days).
