LEASE RIDER. This Rider is attached to and made a part of the Lease dated October 30, 1998 by and between KOGEX XXXITY, INC., a Florida Corporation ("Landlord") with its principal office at 8880 Xxxxxxx Xxxxxxxx Xxxxx, Xxxxxxxxxxxx, Xxxxxxx, 00000, xxd SYNCHRONICITY, INC., a corporation organized and existing under the laws of the State of Massachusetts ("Tenant") with its principal office at 201 Xxxxxx Xxxxxx, Xxxxxxxxxxx, XX 00000.
LEASE RIDER. Subsequent to the execution of the Memorandum of Lease, the Parties shall execute and thereafter record with the County Recorder of San Diego County (i) a lease rider for the benefit of the California Finance Housing Agency relating to this Ground Lease substantially conforming in form and substance to the Lease Rider Agreement (Ground Lease) attached hereto as Exhibit F and incorporated herein by this reference, with non-substantive modifications as may be agreed to by the Agency Executive Director or designee and Agency General Counsel (the “CalHFA Lease Rider”); and (ii) a lease rider for the benefit of the Department of Housing and Community Development relating to this Ground Lease substantially conforming in form and substance to the Lease Rider and Estoppel Agreement (Ground Lease) attached hereto as Exhibit G and incorporated herein by this reference, with non-substantive modifications as may be agreed to by the Agency Executive Director or designee and Agency General Counsel (the “HCD Lease Rider”). Any and all substantive modifications prior to recordation to either the CalHFA Lease Rider or the HCD Lease Rider that do not substantially conform with Exhibits F and G respectively, shall be submitted to the Agency Board for approval.

LEASE RIDER. In the event the LESSOR (OWNER) becomes delinquent in the payment of any Regular or Special maintenance assessment due Pompano Beach Club (delinquent as stated in Bylaws and / or Rules and Regulations) the LESSEE (TENANT) upon receiving written notice of such delinquency from Pompano Beach Club, shall pay the full amount of such delinquency as set forth in said notice to Pompano Beach Club for the benefit of said Association. LESSEE is authorized to deduct from rental payment due to the LESSOR the amount paid to above said Association to cure delinquency. It is understood and agreed by the LESSOR that once the original delinquency has been satisfied, that the LESSEE shall continue to pay on the first day of each month the monthly equivalent of any assessment due thereafter to above said Association until the expiration of the lease. It is further understood and agreed such deduction from the rental payment will not constitute default of rent to the LESSOR. It is understood the Association when in compliance with their obligation, as stated in paragraph one above, has the right to evict the TENANT(S) for non-payment of the Association’s assessments with seven days notice or what otherwise may be required by law. Additionally, the LESSOR understands payments to the Association by the LESSEE in compliance with the above effectively are to be considered payment to the LESSOR and cannot pursue eviction for failure to receive those payments (funds) personally.
