Leases Affecting Mortgaged Property. Mortgagor shall comply with and perform in a complete and timely manner all of its obligations as landlord under all Leases affecting the Mortgaged Property or any part thereof. The assignment contained in Sections (E) and (F) of the Granting Clauses shall not be deemed to impose upon Lender any of the obligations or duties of the landlord provided in any Lease.
Leases Affecting Mortgaged Property. (a) The Mortgagor shall comply with and observe its obligations as landlord or tenant under all leases affecting the Mortgaged Property or any part thereof. If requested by Lender, Mortgagor shall furnish Lender with executed copies of all leases now or hereafter existing on the Mortgaged Property; and all leases now or hereafter entered into will be in form and substance subject to the approval of Lender. Mortgagor shall not accept nor make payment of rent more than one (1) month in advance without the express written consent of Lender. If requested by the Lender, the Mortgagor shall execute and deliver to Lender, as additional security, such other documents as may be requested by Lender to evidence further the assignment to Lender hereunder, and to assign any and all such leases whether now existing or hereafter created, including, without limitation, all rents, royalties, issues and profits of the Mortgaged Property from time to time accruing. The Mortgagor shall not cancel, surrender or modify any lease affecting the Mortgaged Property or any part thereof without the written consent of the Lender. The Mortgagor shall keep in full force and effect the Leases and all permits and licenses required for the conduct of its operations on the Mortgaged Property.
(b) Mortgagor promptly, fully and faithfully will perform and observe all of the terms, covenants, obligations and conditions required to be performed and observed by Mortgagor as lessor or lessee under any lease of the Mortgaged Property, within the periods provided in the respective Lease, and will do all things necessary to preserve and to keep unimpaired its and Lender’s rights under this Mortgage and each Lease;
(c) Mortgagor promptly will (i) notify Lender in writing of the receipt by Mortgagor of any notice from any landlord noting or claiming any default by Mortgagor in the performance or observance of any of the terms, covenants, obligations, and/or conditions on the part of Mortgagor to be performed or observed under any lease; (ii) notify Lender in writing of the receipt by Mortgagor of any notice from any landlord or tenant to Mortgagor of termination of any lease or of Mortgagor’s right to possession of the Property; and (iii) cause a copy of each such notice received by Mortgagor from any landlord or tenant to be delivered to Lender;

Leases Affecting Mortgaged Property. Mortgagor will comply with and observe its obligations as landlord under all Leases affecting the Mortgaged Property or any part thereof so long as the lessee under any of the Leases is not in default. Mortgagor will furnish Mortgagee with a form of lease, which shall not be substantially modified without the prior written consent of Mortgagee. All Leases shall be inferior and subordinate in all respects to the lien of this Mortgage, and shall provide that lessees under such Leases, at Mortgagee’s option, shall attorn to Mortgagee, its successors and assigns, in the event that this Mortgage is foreclosed and the terms of each lease shall so provide.

Mortgagor, if required by Mortgagee, shall furnish promptly to Mortgagee executed copies of all such leases now existing or hereafter created, all of which shall be in forms and substance subject to the approval of Mortgagee.

Each of the leases shall contain a provision requiring the tenant to notify Lender of any default by landlord and granting an opportunity for a reasonable time after such notice to cure such default prior to any right accruing to the tenant to terminate such lease. Mortgagor, if requested by Lender, shall furnish promptly to Lender (i) original or certified copies of all such leases now existing or hereafter created, as amended from time to time, and (ii) a current rent roll in form satisfactory to Lender. Lender shall have the right to notify at any time and from time to time any tenant of the Mortgaged Property of any provision of this Mortgage.
(b) The assignment contained in Section (H) of the Granting Clauses shall not be deemed to impose upon Lender any of the obligations or duties of the landlord or Mortgagor provided in any lease.

Mortgagor will comply with and observe its obligations as landlord under all leases affecting the Mortgaged Property or any part thereof, whether now in existence or entered into in the future. Mortgagor will furnish Mortgagee with executed copies of all leases now or hereafter created on the Mortgaged Property, pursuant to the terms of Section 1.15 below. All leases now or hereafter entered into will be in form and substance acceptable to Mortgagee. Other than may be reasonably necessary in the ordinary course of Mortgagor's business, Mortgagor will not modify, surrender, or terminate, either orally or in writing, any lease agreement now existing or hereafter created upon the Mortgaged Property, nor will Mortgagor permit an assignment or sublease thereof without the express prior written consent of Mortgagee, which consent shall not be unreasonably withheld.
Leases Affecting Mortgaged Property. The Mortgagor will comply with and observe its material obligations as landlord under all leases affecting the Mortgaged Property or any part thereof. If requested by Mortgagee, Mortgagor will furnish Mortgagee with executed copies of all leases now or hereafter created with respect to all or any part of the Mortgaged Property; and all leases now or hereafter entered into must be approved by Mortgagee in advance of Mortgagor becoming obligated upon any such leases. Mortgagee hereby acknowledges that Mortgagee has approved those leases in effect with respect to the Mortgaged Property as of the date of execution of this Mortgage which have been previously provided or made available by Mortgagor to Mortgagee for review. If requested by the Mortgagee, the Mortgagor will execute one or more separate assignments to the Mortgagee of any and all such leases, whether now existing or hereafter created, and all rents, royalties, issues, and profits of the Mortgaged Property from time to time accruing. Except as provided in the Loan Agreement, Mortgagor will not cancel, surrender, or modify any lease without the written consent of the Mortgagee.
