Leave payable on termination. 34.16.1 An employee, or where applicable his or her legal representative, must be paid in lieu for Long Service Leave accrued but not taken as at the date of termination of service where the accumulated period of recognised service is 5 years or more. Calculation for such payment must be in accordance with clause 34.5. 34.16.2 Provided that where an employee has had prior service with another employer recognised, there is no entitlement to payment of accrued long service leave on termination unless the employee has completed 3 year’s continuous service with their current employer.
