Legal Fees and Court Costs. In the event that any action, suit or other proceeding in law or in equity is brought to enforce the provisions of this Agreement, and such action results in the award of a judgment for money damages or in the granting of any injunction in favor of the Company, all expenses (including reasonable attorneys’ fees) of the Company in such action, suit or other proceeding shall be paid by the Executive. In the event that any action, suit or other proceeding in law or in equity is brought to enforce the provisions of this Agreement, and such action results in the award of a judgment for money damages or in the granting of any injunction in favor of the Executive, all expenses (including reasonable attorneys’ fees and travel expenses) of the Executive in such action, suit or other proceeding shall be paid by the Company.

The Landlord shall be allowed to demand and recover costs and expenses (including without limitation, reasonable attorneys fees and investigative and court costs) incurred in order to enforce any duty, obligation performance or covenant or to collect any amounts due Landlord hereunder. When incurred during the tenancy of any Tenant, such amounts shall become additional Monthly Rent due hereunder. Any rental or damages which remain unpaid after default shall bear interest at the rate of twelve percent (12%) per annum.

It is agreed that if any action is brought in a court of law by any party to this Agreement as to the enforcement, interpretation or construction of this Agreement, or any document provided herein, the prevailing party in such action shall be awarded to reasonable attorney’s fees as well as all costs incurred in the prosecution or defense of such action.

In the event the Executive initiates legal action against Company for an alleged breach of any provision of this Agreement, and, solely in the event the Executive's action is finally adjudicated in his favor and against Company, and only after such event, all reasonably necessary expenses incurred by the Executive, including, without limitation, attorneys' fees pursuant to such legal action will be reimbursed to the Executive by Company within ten (10) days of the Executive presenting an invoice to Company. The provisions of this Section shall survive any termination of this Agreement by Company or the Executive and remain enforceable despite the nature of any contest between the Executive and Company which may arise.

Interest on any past due amounts owed under this lease, or on any court judgment for money damages, shall accrue at the highest (18%) percentage allowed by law without demand and such interest is hereby defined, considered and intended to be additional rent; it is further understood and agreed between the parties hereto that time is of the essence in this lease and applies to all terms and conditions contained herein. In the event of a default under this lease, each maker authorizes the garnishment or attachment of his/her wages to the fullest extent permitted by law, including without limitation, Florida Statue 222.11(2) (b) (1993) as amended from time to time.

In the event of any litigation between the Parties under this Agreement, each Party shall be responsible for its own attorney’s fees and court costs through trials and appellate levels. The provisions of this paragraph shall survive the expiration or early termination or cancellation of this Agreement.

In the event that legal proceedings are --------------------------- instituted to collect any amount due upon any installment of this note, the undersigned, jointly and severally, agree to pay to the holder hereof in addition to the amount of the unpaid balance or principal and accrued unpaid interest, all costs and expenses of such proceedings, plus reasonable attorney fees.
