Common use of Legal Proceedings Leave Clause in Contracts

Legal Proceedings Leave. A teacher of the Bargaining Unit shall be granted on a day-to-day basis an absence, with pay, for any court appearances and legal proceedings to which he/she is summoned. The provisions of this item exclude any legal action initiated by the teacher or any action resulting from a criminal charge filed against the teacher. The District shall grant a teacher leave for jury service or as a witness subpoenaed in a criminal, civil or juvenile proceeding and shall pay the teacher during such service the full, current contract salary. If a teacher is required to attend legal proceedings related to his/her role as a BPS employee outside of the contractual work day/hours the district will consider compensation on a case-by-case basis to be approved or denied by the Superintendent. All documentation requested must be submitted along with the request including but not limited to a copy of the summons received requiring his/her court appearance as well as a copy of any check(s) received in order to allow the district to accurately account for the court service.
