Common use of Legal Services Clause in Contracts

Legal Services. 25.1 Except in cases of malfeasance in office or willful or wanton neglect of duty, the Employer shall defend, save harmless, and indemnify employee against tort claim or demand, whether groundless or otherwise, arising out of alleged acts or omission occurring in the performance or scope of the employee’s duties. 25.2 Notwithstanding 25.1, the Employer shall not be responsible for paying any legal service fee or for providing any legal service arising from any legal action where the employee is the plaintiff.

Legal Services. 25.1 15.1 Except in cases of malfeasance in office or willful or wanton neglect of duty, the Employer shall defend, save hold harmless, and indemnify employee against any tort claim or demand, whether groundless or otherwise, arising out of an alleged acts act or omission occurring in the performance or and scope of the employee’s duties. 25.2 15.2 Notwithstanding 25.115.1., the Employer shall not be responsible for paying any legal service fee or for providing any legal service arising from any legal action where the employee is the plaintiff.
