Level Two. An employee who is required to deliver medication to residents in residential aged care facilities: • previously defined as Nursing Homes (as at 31 December 2004) by the Nursing Homes Act 1988 (NSW); or • in which more than 80% of places are “allocated high care places” as defined in the Aged Care Act 1997 (Cth). An employee at this level must hold the following qualifications, which may be varied from time to time by the relevant National Vocational, Education and Training Body: • a Certificate III in Aged Care Work (CHC30102); and • a Certificate IV in Aged Care Work (CHC40102); and • medication module – “Provide Physical Assistance with Medication” (CHCCS303A); or Hold other appropriate qualifications acceptable to the employer. Employees at this level may be required to perform the duties of a CSE 4 - Level 1.
Level Two. If the aggrieved person is not satisfied with the disposition of his/her grievance at Level One, or if no decision has been rendered within 5 (five) days after discussion of the grievance he/she may file the grievance in writing within 10 (ten) days of the Level One response with the superintendent of schools.
Level Two. If the grievant is not satisfied with the written response at Level One, or a written response has not been received within the time limit specified herein, the grievant may file a written appeal to the District Administrator responsible for handling grievances. This appeal must be received within seven (7) days following receipt of the written response rendered by the principal or supervisor, or in the absence of such written response, within seven (7) days of the expiration date of the time period specified for such written response.
a. The District Administrator responsible for handling grievances (“Level Two Administrator”) will represent the Superintendent at Level Two of the grievance procedure.
b. Within forty-eight (48) hours, or two days, whichever is longer, of its receipt, the District will provide the CCEA President with copies of any grievances filed at Level Two (including the Level One form and the Form B response to it unless such response was not given) unless the Association is already the grievant’s representative or a party to the Level Two grievance. The District will notify the CCEA of the date and time for the Level Two hearing, and the CCEA will be allowed to have a representative present at the proceedings.
c. The Level Two Hearing will take place at a mutually agreeable time within seven (7) days after the receipt of the written appeal from the grievant or at a later mutually agreed upon time.
d. At the initial meeting of Level Two, the Level Two Administrator will hold a hearing at which both the grievant, with or without a representative(s) chosen by the grievant, and the appropriate administrator(s) are present.
e. After the Level Two Hearing, the Level Two Administrator may investigate and consult with the grievant and/or the appropriate administrator(s) in an effort to resolve the grievance.
f. Within ten (10) days after the hearing, the Level Two Administrator will provide a written document on the proposed resolution of the grievance to all parties of interest, including CCEA, setting forth the decision and its rationale.
Level Two. If the grievant is not satisfied with the recommendation made in Level One, he may, within five (5) days after receipt of such written response, file his written grievance with the Superintendent and request a meeting to discuss the grievance. The meeting with the Superintendent shall be within five (5) days after the request is received by the Superintendent. The meeting shall be conducted in the manner provided for in Level One. Within five (5) days after the meeting, the Superintendent shall provide the grievant with a written response stating his position and recommendation for the resolution of the grievance.
Level Two. An employee will be entitled to progress to the Level Two rate for all hours and duties performed in the care stream in accordance with the following conditions. The employee must: • be employed as a CSE 2; • have worked in the Care Stream for a minimum of 2 years; and • possess a Certificate III in Individual Support (CHC33015) or a Certificate III in a similar field acceptable to the employer.
Level Two. If no-one qualifies at Level One, or a qualified person does not want the tenancy, it may be inherited by a member of your family as long as: • he or she is aged at least 16 at the date of death; • the house was his or her only or principal home at the date of death. If more than one person qualifies for the tenancy under Level Two, they must decide among themselves who should get the tenancy. If they cannot agree, we will decide.
Level Two i. If the aggrieved person is not satisfied with the disposition of his/her grievance at Level One, or if no decision has been rendered within five (5) days after discussion of the grievance, he/she may file the grievance in writing with the school principal within ten (10) days of the Level One response. The grievance form can be found in Appendix C of this Agreement.
ii. Within five (5) school days after receipt of the written grievance by the principal, the principal will meet with the aggrieved person in an effort to resolve it. The principal shall submit his/her decision in writing to the aggrieved person within five (5) days after the meeting.
Level Two. (1) Within ten (10) days of the disposition at Level One, if the grievant is not satisfied, he/she shall submit the grievance in writing to the Superintendent or his/her designee.
(2) The Superintendent or his/her designee shall:
(a) Meet with the grievant within five (5) days of receipt of the grievance;
(b) Within five (5) days after the meeting referred to in (2)(a) above, submit a written response to the grievant, the appropriate administrator, and the Association.
Level Two. If a grievance arises from any action or inaction at the campus level, the grievance shall initiate with the President/Xxxxxxx as respondent.
Level Two. If the grievance is not settled at Level One, it may be appealed to the Board by filing a written notice with the Board's chief administrator, the Superintendent, stating the grounds for the appeal. A meeting with the Board or its designated representative(s) shall be held within ten (10) days following the receipt of such notice and the Superintendent shall promptly notify the grievant and the Association of the date, the time, and the place where such appeal shall be heard. The Board's written decision shall be transmitted to the grievant and the Association within ten (10) days after the hearing.
