Initiation and Processing. 1. Failure, at any step of this procedure, to communicate the decision on a grievance within the specified time limits shall permit the aggrieved person to proceed to appeal a grievance to the next step. Failure to proceed within the specified time limits initiation and processing shall be deemed to be acceptance of the decision tendered at that step. a) Level One - Principal. 1. Any teacher who has a grievance, shall discuss it first with his/her immediate supervisor or building principal, if applicable, in an attempt to resolve the matter informally at that level. The teacher shall state at the meeting that this is Level One of the grievance process. 2. If, as a result of the discussion, the matter is not resolved to the satisfaction of the teacher within five (5) school days, he/she shall set forth his/her grievance in writing to the principal specifying: (a) the nature of the grievance and date occurred; (b) the nature and extent of the injury, loss or inconvenience; (c) the results of previous discussions; (d) his/her dissatisfaction with decisions previously rendered. The principal shall communicate his/her decision to the teacher in writing within three (3) school days of receipt of the written grievance. 3. Grievances arising out of decisions made by the Superintendent or the School Board may bypass Level One and be submitted initially at Level Two. b) Level Two - Superintendent. The teacher, no later than five (5) school days after receipt of the principal's decision, may appeal the principal's decision to the Superintendent. The appeal must be made in writing, reciting the matter submitted to the principal, as specified above, and his/her dissatisfaction with decisions previously rendered. The Superintendent shall meet with the employee to attempt to resolve the matter, as quickly as possible, but within a period not to exceed five (5) school days. The Superintendent shall communicate his/her decision in writing to the employee, the principal, and the immediate superior or department head, if applicable, within five (5) school days. c) Level Three. If the grievance is not resolved to the grievant's satisfaction at Level Two, he/she may either request a review by the Board or request that the Association submit the issue to arbitration. Arbitration shall be advisory only. Initiation and Processing. 1. Level One a. A grievance to be considered under this procedure must be initiated, at Level One, in writing within twenty (20) days from the time the grievant knew of its occurrence. An employee with a grievance shall first notify his/her immediate administrative officer of the situation. The matter will then be discussed between the two parties with a member of the Grievance Committee of the Association. The objective of the first discussion will be the informal resolution of the matter and it shall be held within seven (7) days after written notification of the grievance, at a time mutually convenient to the parties concerned.

An allegedly aggrieved staff member or the Association shall submit a grievance in writing to the immediately involved administrator or supervisor. The administrator or supervisor shall have five days to hold a hearing and present a written decision on the grievance to the aggrieved and the Association. Step 2. Should the Association be dissatisfied with the administrator’s disposition of the matter, it shall refer the matter to the Superintendent within thirty days. The Superintendent or appointee shall meet with the aggrieved and the representative of the Association within five days of the submission of the matter to the Superintendent. Each party shall have the right to include in its representation appropriate witnesses and consultants, who shall have the full right to participate as called upon by the inviting party. Upon conclusion of the hearing, the Superintendent shall have five days in which to give a written decision on the grievance to the aggrieved and to the Association. Step 3. If the Association is not satisfied with the disposition of the grievance in Step 2, or if the Superintendent fails to comply within the specified time limit, then the grievance may be submitted within ten days to binding arbitration. If within fifteen (15) days of the filing of the demand with the District the parties cannot agree on an arbitrator, the demand shall be submitted to the American Arbitration Association which shall act as administrator at the proceedings. Failure at any step of this procedure to appeal a dispute to the next step within the specified time limits shall be deemed to be acceptance of the decision rendered at that step. If the Department does not answer in writing, within the time periods provided, the grievance shall be considered resolved in the 2. In the event a dispute cannot be resolved informally by discussion with a superior, the following steps shall be followed in the order given: Step 1. The dispute shall be submitted to the Chief of Police in writing by the officer with a copy to his/her supervisor no later than fourteen (14) work days after the incident. Step 2. The Chief of Police shall reply, in writing, within seven (7) work days. Step 3. If the matter remains unresolved, the written reports of the officer and supervisor and written report of the Chief of Police shall be submitted to the Police Commission within seven (7) work days with copies of the reports being forwarded to the aggrieved Party. The Commission shall meet with the officer within twenty (20) work days in public or private at the officer’s choice and the Police Commission shall render its decision, in writing, within ten (10) work days of the date the matter was heard by the Commission. 3.
