Legislative drivers. This ISA has been prepared to support the sharing of personal information between Partners regarding children and families ‘in need’, ‘at risk’, requiring protection from harm and to promote, support and safeguard the welfare and wellbeing of children and young people. Information will only be shared where sharing is permitted in terms of the General Data Protection Regulation, the Data Protection Act and other regulations and guidance applicable to the partner organisations. Getting it right for every child is the national approach in Scotland to improving outcomes and supporting the welfare and wellbeing of our children and young people by offering the right help at the right time from the right people. Safety is a key aspect of wellbeing and all children in Lanarkshire have the right to be protected from abuse or neglect. Working with partners, children and young people and their parents we are ensuring that an effective continuum of support is in place from all services in Lanarkshire ensuring that the rights of children and families are foremost, and effective procedures are in place to promote and support wellbeing and ensure that children are safeguarded wherever there is a likelihood or risk of harm. The ISA supports the Public Tasks of statutory partners to the agreement through a variety of statutory functions (listed in section 1.2.2 of this ISA) and in the public interest. Through the lawful, fair and transparent sharing of relevant information, proportionate to the needs of the child or young person, we will work together to ensure that wherever possible the life chances of children are maximised, that they live healthy lives and any risk to safety is prevented or addressed. It supports the Lanarkshire Data Sharing partner organisations involved and the groups of Service Users it impacts upon. It details the specific purposes for sharing and the personal information being shared, the required operational procedures, consent processes, and legal justification.

In the event that any term, condition or provision, or part thereof, which is incorporated into this Agreement, whether by inadvertence, error or misunderstanding, is in fact or in law contrary to such federal or provincial legislation or regulation, then such term, condition or provision or part thereof, is void and of no effect.
