LIMITATION OF STALE GRIEVANCES. A grievance shall be void unless presented within 60 calendar days after the date upon which the County has allegedly failed to provide a condition of employment. This 60 calendar day filing requirement is tolled only in the following applications: 1. To up to 60 calendar days after the County’s alleged failure was reasonably discoverable, or, 2. Up to 60 calendar days after when the grievant may reasonably claim he or she delayed the filing of a grievance as a direct consequence of representations made by the County upon which the grievant relied to his/her detriment. An arbitrator shall have no power or jurisdiction to award any monetary damages or relief for any claim that is stale, or beyond a 60 day period, as set forth herein. 1. The 60-day period is limited to that which immediately precedes the filing of the grievance, or, 2. The 60-day period is limited to that which immediately precedes the date upon which the grievant reasonably discovers the basis for the grievance or can be reasonably found to have delayed in filing due to detrimental reliance upon representations made by the County, as set forth in Section L, 1 and 2 above.
