Limitation on the Department's Obligations. The obligations of the Department under this Agreement are limited and subject to the availability of funds.
Limitation on the Department's Obligations. A. The obligations of the Department to make payments to the Primary Contractor are limited and subject to the availability of funds appropriated by the General Assembly of the Commonwealth and certified by the Comptroller. The Primary Contractor agrees that this limitation will not discharge any of the Primary Contractor's obligations under this Agreement, except as otherwise provided.
B. If the Primary Contractor provides services under this Agreement for which the Department is unable to make timely payment due to the unavailability of funds, the Department will make all such payments that have been missed when funds become available.
