Common use of Limitations Upon Arbitrator Clause in Contracts

Limitations Upon Arbitrator. (a) An arbitrator shall not be authorized to alter, modify, amend or add to any part of this agreement. (b) No person shall be appointed as an arbitrator who has been involved in an attempt to negotiate or settle the grievance, unless requested to do so with the consent of both parties prior to the commencement or in the course of the arbitration hearing. (c) Each party shall be responsible for an equal share of the fee and expenses of the arbitrator. If a grievance is heard by an Arbitration Board rather than by a single arbitrator, each party shall be responsible for the fees and expenses of its own nominee to the Board of Arbitration.
